NOTICE OF TRUSTEE’S SALE Notice is hereby given that by virtue of authority vested in the undersigned Trustee by that certain deed of trust executed by DENISE A. COPLEY to JOYCE CLARK, dated the 17th day of March, 2010, securing HABITAT FOR HUMANITY OF THE TRI-STATE, INC, and recorded in the office of the Clerk of the County Commission of Wayne County, West Virginia, in Trust Deed Book No. 751, at page 877, by which was conveyed to the said Trustee the hereinafter described real estate, to secure the payment of a certain note set out and described therein, and the owner and holders of said note, in exercise of the right and authority granted in the aforementioned deed of trust, having appointed FLYNN, MAX, MILLER & MILLER, L.C. as Substitute Trustee, by that certain Appointment of Substitute Trustee dated the 14th day of March, 2024, and recorded in the aforesaid Clerk’s Office in Trust Deed Book 869, at page 420, and default having been made in the payment of said note, and the said FLYNN, MAX, MILLER & MILLER, L.C., Substitute Trustee, having been requested so to do by the owner and holder of said note, shall sell to the highest and best bidder, on May 1, 2024 at 10:00, at the Front Door of the Court House of Wayne County, West Virginia, the following described real estate: All that certain piece, tract or parcel of real estate situated lying and being on the waters of Mill Creek and near Fort Gay, Butler District, Wayne County, West Virginia, and being more particularly bounded and described as follows: BEGINNING at a garden post at Mary Wheeler’s line; thence straight up a hill 290 feet to another post; thence straight around the hill 280 feet to branch; thence down the branch to road, or land accepted in first parties’ deed; thence straight on to the forks of the branch, and back to the beginning, containing about TWO (2) ACRES, be the same more or less, together with all appurtenances thereunto belonging. TERMS OF SALE: Ten percent (10%) cash in hand on day of sale with the balance due within 30 days, subject to any and all unpaid taxes, and purchaser pays all transfer tax, the deed preparation and recording fee.
