ALBANS WEST VIRGINIA STATE TAX DEPARTMENT Defendants. The object of the above styled action is to quiet title and vest title in the real property, free and clear of all claims of the above as to that certain lot, tract, or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in the City of St. Albans, St. Albans District, Kanawha County, West Virginia identified on the 2023 Kanwha County Assessor records as Pt Lts 1-2-3 Bk A & 10 Ft Alley, Tax Map 21, Parcel 75.1, Account #07282978, and is believed to have a property address of 804 Monmouth Street, St. Albans, WV 25177, and being described in that certain Deed from TASHPA, LLC unto Sam-Corp Developments, Inc., dated August 31, 2022, and of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia in Deed Book 3144, at page 484, reference to which is made for a more particular description. Being the same real estate conveyed unto Carrol L. Croson and Marjorie N. Croson from Koury Corporation by Deed dated September 9, 1976, and recorded in the aforesaid Clerk’s Office in Deed Book 1812, at page 255. The aforesaid, Carrol L. Croson died on January 31, 2014, and pursuant to the survivorship provisions of the aforesaid Deed title vested solely in Marjorie N. Croson. The aforesaid Marjorie N. Croson is the same person as Marjorie A. Croson, died-on February 23, 2017, and the estate was opened in Kanawha County, West Virginia and an appraisement of said estate was filed and recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia in Will Book 918, at page 618. The property was sold at the November 2020, tax sale, a Deed was issued to TASHPA, LLC by Vera J. McCormick, Clerk of the County Commission of Kanawha County, West Virginia, on April 13, 2022, and recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia in Deed Book 3127, at page 713. TASHPA, LLC thence conveyed the property herein, unto Sam-Corp Developments, Inc., on August 31, 2022, by a deed of record in the aforesaid Clerk’s Office in Deed Book 3144, at page 484. 1. The aforesaid Marjorie A. Croson a died-on February 23, 2017, and no Estate was opened in Putnam County, West Virginia, however the estate was opened in Kanawha County, West Virginia and an appraisement of said estate was filed and recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia in Will Book 918, at page 618. 2. The Administrator of the Estate was the Kanawha County Sheriff, who filed a Amended Affidavit of Heirs and Distributees on July 11, 2019, and recorded same in the aforesaid Clerk’s Office in Fiduciary Book 326, at page 367. 3. Pursuant to the affidavit of heirs above, the following have been identified as heirs of Marjorie Ann Croson: Joseph W. Nease, Sharon Nease Crowell, Richard E. Nease, Mary Nease Smith, Clyde G. Nease, Deborah Nease, Steven Nease, Garrett L. Nease, Amber Nease Smith, Collect E. Nease, Gregory Nease, Allan Nease, Terry Nease, Eric Nease, David W. Nease, Bradley Nease, Martin S. Nease. 4. The aforesaid Clyde G. Nease, Steven Nease, Collect E. Nease, Terry Nease, David W. Nease and Martin S. Nease all are identified as deceased; however no address or estate information was found of record. 5. Since the filing of the aforesaid affidavit of heirs the following have been found to be deceased: Sharon Nease Crowell and Mary Nease Smith. 6. The said Sharon Nease Crowell a Sharon Jean Crowell, died on February 9, 2021, and pursuant to her Last Will and Testament devised everything to her husband Russel Edward Crowell, which is recorded in Kanawha County in Will Book 66, at page 312. 7. The aforesaid Russel Edward Crowell died March 20, 2022, in Putnam County West Virginia and was survived by Jeremy E. Crowell and David M. Crowell and no estate was opened. 8. The said Mary Nease Smith aka Mary Pricilla Smith died on October 5, 2021, and pursuant to her Last Will and Testament of record in Kanawha County Will Book 66, at page 551, devised everything unto Jeremy E. Crowell and David M. Crowell. 9. A review of all other records in Putnam, Kanawha, Wayne, Wood Counties West Virginia and Marion County Ohio, found no other death or heirship information for any living or deceased party was found. And it appearing that the identity and whereabouts of some of the party Defendants are unknown or not determinable and there may be persons other than those named in the Complaint interested in the subject matter of this action, whose names and whereabouts are unknown to the Plaintiff, it is ORDERED that the above named Defendants, together with any persons holding an interest in the above described property, serve upon L. Richard Dorsey, II, Plaintiff’s attorney, whose mailing address is P.O. Box 1083, Hurricane, West Virginia 25526, an answer or any defense to the Complaint filed in this action on or before, June 17, 2024, otherwise judgment by default may be taken against the Defendants, at any time thereafter.
