Activity:
To operate and maintain an existing 1.2 million gallons per day wastewater collection and treatment system. These facilities are designed to serve a population equivalent of 12,000 persons in the Shady Spring Public Service District, and its environs, and discharge treated wastewater via Outlet No. 001 to Piney Creek [approximately 12.1 miles from its mouth] of the New River of the Kanawha River.

Also, to incorporate the requirements relative to Title 33, Series 2 of the West Virginia Legislative Rules for the processing and disposal of sewage sludge generated by the wastewater treatment plant. Sewage sludge generated and/or processed at the permittee’s facility shall be land applied, provided that the sewage sludge shall not be applied in a manner that exceeds the agronomic or lifetime loading rates. This land application site meets all other regulatory standards and is identified as follows: Meador Wood Products, Inc., located at Ellison Ridge Road, Flat Top, WV. Also, sewage sludge generated and/or processed at the permittee’s facility shall be disposed of at a sanitary landfill by placing the sewage sludge in the landfill cell.

Also to acquire, construct, install, operate and maintain improvements and construction of a new 0.4 MGD extended aeration treatment unit to expand the Outlet 001 wastewater treatment plant capacity from 1.2 MGD to 1.6 MGD with all the requisite appurtenances. Additional work also includes a new mechanical bar screen, modifications to the flow splitter box, replacement of two (2) other 0.4 MGD treatment unit mechancial components, cleaning and diffuser replacement of a fourth 0.4 MGD treament unit, new non-potable water lines, new blowers, and an additional UV disinfection system. These facilities are designed to serve a population equivalent of 12,000 persons in the Shady Spring Public Service District, and its environs, and discharge treated wastewater via Outlet No. 003 to Piney Creek [approximately 12.1 miles from its mouth] of the New River of the Kanawha River.

An antidegradation review has been conducted and Tier 1 and Tier 2 protection are provided for the uses specified in 47 CSR 2, Section 6 for Outlet Nos. 001 and 003 respectively.

Compliance shall be attained in accordance with the Order No. 10022, issued December 1, 2021, and any amendments, thereto.

On the basis of review of the application, the “Water Pollution Control Act (Chapter 22, Article 11-8(a)),” and the “West Virginia Legislative Rules,” the State of West Virginia will act on the above application.

Any interested person may submit written comments on the draft permit and may request a public hearing by addressing such to the Director of the Division of Water and Waste Management within 30 days of the date of the public notice. Such comments or requests should be addressed to:

The public comment period begins May 10, 2024 and ends June 09, 2024.

Comments received within this period will be considered prior to acting on the permit application. Correspondence should include the name, address and the telephone number of the writer and a concise statement of the nature of the issues raised. The Director shall hold a public hearing whenever a finding is made, on the basis of requests, that there is a significant degree of public interest on issues relevant to the Draft Permit(s). Interested persons may contact the public information office to obtain further information.
