Activity:
To operate and maintain an existing 2.0 million gallons per day wastewater collection and treatment system to serve a population equivalent of approximately 9,614 persons in the Crab Orchard/MacArthur Public Service District and its environs and discharge treated wastewater via Outlet No. 001 to Piney Creek [approximately 14.0 miles from its mouth] of the New River of the Kanawha River. Also, to accept non-domestic wastewater from Walker Machinery and Walmart Supercenter #5319. Also, to incorporate the requirements relative to Title 33, Series 2 of the West Virginia Legislative Rules for the processing and disposal of sewage sludge generated by the wastewater treatment plant. Sewage sludge generated and/or processed at the permittee’s facility shall be land applied, provided that the sewage sludge shall not be applied in a manner that exceeds the agronomic or lifetime loading rates. These land application site(s) meet all other regulatory standards and are identified as follows: Thomas F. Cooper, Cooper Farm Road, near Whitby, WV; Glen McKinney, Sullivan Road, Crab Orchard, WV; Meador Wood Products, Ellison Ridge Rd, Flat Top, WV. Also, sewage sludge generated and/or processed at the permittee’s facility shall be disposed of at a sanitary landfill by placing the sewage sludge in the landfill cell. An antidegradation review has been conducted and Tier 1 protection is provided for the uses of the receiving stream for Outlet No. 001.

On the basis of review of the application, the “Water Pollution Control Act (Chapter 22, Article 11-8(a)),” and the “West Virginia Legislative Rules,” the State of West Virginia will act on the above application.
Any interested person may submit written comments on the draft permit and may request a public hearing by addressing such to the Director of the Division of Water and Waste Management within 30 days of the date of the public notice. Such comments or requests should be addressed to:

The public comment period begins May 21, 2024 and ends June 20, 2024.
Comments received within this period will be considered prior to acting on the permit application. Correspondence should include the name, address and the telephone number of the writer and a concise statement of the nature of the issues raised. The Director shall hold a public hearing whenever a finding is made, on the basis of requests, that there is a significant degree of public interest on issues relevant to the Draft Permit(s). Interested persons may contact the public information office to obtain further information.
