Bayer CropScience, LP is located in Institute, in Kanawha County, West Virginia, at latitude 38DEGREES 23′ 22″ N and longitude 81DEGREES 46′ 48″ W. This permit will be issued under authority of West Virginia Code, Chapter 22, Article 18. The State of West Virginia is authorized to administer and enforce a hazardous waste management program, in lieu of the federal program for portions of the Resource Conservation and Recovery Act of 1976 (RCRA), and the Hazardous and Solid Waste Amendments of 1984 (HWSA). HWSA imposes additional requirements on hazardous waste management facilities that will be enforced by the U.S. Environmental Protection Agency (EPA) until the State of West Virginia receives authorization for those requirements. State law (Chapter 22, Article 18 of the W.Va. Code) requires Bayer CropScience, LP to have a permit for the operation of its various unit(s). State law also requires that DEP provide the public with an opportunity to participate in the permitting process via public notice and an opportunity to request a hearing. A copy of the administrative record, including the permit application, draft permit, and fact sheet will be available for review at the DEP office located at 601 57th Street SE, Charleston, WV 25304. If a public hearing is warranted, the director will provide the public with a notice of at least 30 days prior to the scheduled hearing. Following the comment period, the director will make the permitting decision. If the terms and conditions of the permit remain substantially unchanged from those announced by this notice, the director will issue the permit and respond to all persons who submitted written comments and to any person who requested the response. If the terms and conditions are substantially changed, the director will offer the public an opportunity for review and comment on substantial changes before the final permitting decision.
