ORDER OF PUBLICATION The object of the above-entitled action is to enforce a “Purchase Agreement and Contract of Sale” dated August 31, 2022 pertaining to certain parcels of real estate with various structures thereon located at 1102 Union Avenue, Barboursville, Cabell County, West Virginia (the “Property”). The Property was formerly owned by the late Carl Eugene Burns, who acquired the Property by Deed recorded in the Office of the Clerk of Cabell County in Deed Book 1189 at Page 321. Carl Eugene Burns passed away intestate on or about July 7, 2021 and his Estate was thereafter established as a Cabell County, West Virginia probate estate. According to the “Application of Fiduciaries” on file with the Cabell County Clerk’s Office, the heirs of the Estate of Carl Eugene Bums are: Robert Bums (brother), Mark Wright (nephew), Diana McComas (niece), Yolonda Starkey (niece) – now deceased, David Gillispie (nephew). More specifically, the action alleges breach of contract pecific performance, misrepresentation, unjust enrichment, and estoppel, among other things. It appearing by affidavit filed in this action that there may be individuals other than those persons named who are interested in the subject matter of this action, and that there are some named parties whose whereabouts are unknown or who may not have been served by other means despite efforts by the Petitioners laintiffs; and r unknown heirs and r beneficiaries of the Estate of Carl Eugene Bums, it is ORDERED that each of them do appear and serve upon Michael S. Bailey, Bailey Legal Services, PLLC, attorney for the Petitioners laintiffs, whose address is 642 Main Street, Suite 201, Post Office Box 347, Barboursville, West Virginia 25504, a response to the Petition filed in this action on or before the 24th day of July, 2024, or attend the hearing which is set in this matter on July 24, 2024 at 10:00 a.m. before the Honorable Sean K. Hammers, Judge of the Circuit Court of Cabell County, West Virginia at the Cabell County Courthouse in Huntington, West Virginia; otherwise judgment by default will be taken against them at any time thereafter.
