NOTICE OF TRUSTEE’S SALE Pursuant to the authority vested in the undersigned Joel P. Jones, Jr., Substitute Trustees by Notice of Substitution of Trustee, Which notice is of record in the Office of the Clerk of the County of Commission of Cabell County, West Virginia, and by Deed of Trust dated 6 April 2016 executed by Jamie Marlowe and Michelle Marlow to John E. Gompers, Trustees, which deed of trust is of record in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Trust Deed Book 2612 at Page 480, the undersigned Substitute Trustee has been requested, in writing, by the beneficiary of said deed of trust to sell the real estate described below, as there has been a default under the terms and conditions of said deed of trust. Therefore, the undersigned Substitute Trustee, with the assistance of Behmn’s Auction & Real Estate Service. LLC, will sell the real estate described in the Deed of Trust, at a public auction on 10 July 2024, at Noon (1200) to the highest bidder at the east front door of the Courthouse of said County of Cabell, in Huntington, West Virginia, which real estate is more completely described as follows: PARCEL NUMBER ONE: All that certain tract or parcel of lands situate in the City of Huntington, Cabell County, West Virginia, and being the northern one-half of all those certain lots or parcels of ground known and designated on the map of the Johnston Addition to the said City of Huntington, which map was filed in the Cabell County Court Clerk’s Office, West Virginia, on September 5, 1892, as Lot No. Seventeen (17) and the West one-half of Lot No. Sixteen (16), of Block No. Three (3), of the said Johnston Addition, being all of the Northern half of the above lot and a half, and being more particularly described as follows: BEGINNING at a point in the south line of the alley between Eighth (8th) and Ninth (9th) Avenues, as shown on said map, 80 feet westerly from the intersection of said alley with the west line of First Street; thence southerly, parallel with First Street, 100 feet; thence westerly, parallel with said alley and with ninth Avenue, 45 feet; thence northerly, parallel with First Street, 100 feet to the south line of said alley; thence with same, easterly 45 feet to the point of BEGINNING. PARCEL NUMBER TWO: The northerly one-half of all those certain lots, pieces or parcels of land situate in the City of Huntington, Kyle District, Cabell County, West Virginia, known and designated on the map of the Johnston Addition to said City of Huntington, which map was filed in the Office of the Clerk of the County Court of Cabell County, West Virginia, on the 5th day of September, 1892, in Map Book No. 1, as Map No. 12, as Lot No. Eighteen (18) and the easterly one-half of Lot No. Nineteen (19) in Block No. Three (3) and being more particularly described as follows: BEGINNING at the point of intersection of the east line of Lot No. 18 and the south line of the alley between Eighth (8th) and Ninth (9th) Avenues, said point being 125 feet westerly from the intersection of said alley with the west line of First Street; thence southerly and parallel with said First Street, 100 feet to a point; thence westerly and parallel with said alley and with Ninth Avenue, 45 feet to a point; thence northerly and parallel with said First Street, 100 feet to the south line of said alley; thence with same, easterly 45 feet to the point of BEGINNING. PARCEL NUMBER THREE: All those certain pieces or parcels of ground situate, lying and being in Kyle District in the City of Huntington, Cabell County, West Virginia, known and designated as Lot No. Seven (7), the easterly fifteen (15) feet of Lot No. Six (6) and the westerly ten (10) feet of Lot No. Eight (8), in Block No. Thirty-One (31) as shown on a map of that certain subdivision of Blocks Nos. 24, 25, 28 and 32, Woodside Place, in the City of Huntington, West Virginia, of record in the Office of the Clerk of the County Court of Cabell County, West Virginia, in Map Book No. 2 as Map 109. TERMS OF SALE 1. The successful bidder (“Purchaser”) shall pay a ten percent (10%) nonrefundable down payment payable to the Trustee at the conclusion of the auction with the balance due and payable within forty-five (45) days from the date of the sale, payable by certified check, cashier’s check, or wired funds. In addition to the purchase price, the Purchaser will be responsible for and shall pay a nonrefundable ten percent (10%) Buyer’s Premium” which will be added to the final bid amount, not applied to the purchase price, and shall be due at the time of sale payable to Behm’s Auction & Real Estate Service, LLC to determine the final aggregate contract price. Remote or online bidding may also be permitted at the discretion of the Trustee. Please contact the auction company in advance of the sale to arrange for remote bidding. If the successful bidder is an online bidder not present at the sale, then the “Buyer’s Premium” shall be increased to thirteen percent (13%). 2. The sale of the property will be made subject to all matters having priority over the deed of trust referred to herein including but not limited to any and all assessments and taxes against said property, all prior liens, encumbrances, lease, restrictions, covenants, conditions, right of ways and easements of any nature whatsoever. 3. The purchaser shall be responsible for the payment of the transfer taxes imposed by West Virginia Code 11-22-2. 4. The subject property will be sold in “AS IS” condition. The Substitute Trustee makes no representations and warranties of any kind or character including, but not limited to, the condition of the real estate or the title to the real estate to be conveyed. 5. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. 6. The Substitute Trustee reserves the right to adjourn the sale, for a time, or from time to time, without further notice by announcement at the time and place of the sale described above. 7. The beneficiary of the Deed of Trust and holder of the note thereby secured reserves the right to submit a bid for the property at the sale, which bid may be in the form of a credit bid. 8.
