NOTICE OF TRUSTEE’S
SALE OF VALUABLE REAL ESTATE
NOTICE IS GIVEN, that the undersigned Trustee, pursuant to the terms of that certain Deed of Trust dated October 14, 2021, executed by DARRELL L. MURPHY to Martha Haymaker and Drew Patton, Trustees, conveying the real estate therein described and hereinafter described, which Deed of Trust is of record in the Office of the Clerk of the County Commission of Clay County, West Virginia, in Trust Deed Book 149, at Page 1046, and further being the same Deed Of Trust in which Calhoun County Bank, Inc., the beneficial owner of the debt did appoint the undersigned Bernard R. Mauser as Substitute Trustee, by Substitution of Trustee dated the 2nd day of April, 2024, of record in the aforesaid Clerk’s Office in Miscellaneous Record Book 36, at Page 997, will, default having been made in the payment of said debt, and the beneficial owner thereof having requested said sale, sell at the front door of the Court House of Clay County, Weston, West Virginia, at public auction to the highest bidder on Thursday, the 30th day of May 2024, at 10:00 o’clock a.m., on that day, the following real estate, together with the improvements thereon and the appurtenances thereunto belonging, situate on the waters of West Fork of the Little Kanawha River, in Otter District, Clay County, West Virginia, and being more particularly described as follows:
FIRST TRACT: 31 acre tract:
BEGINNING at a locust in the running with said line, N. 10 W., 124 poles to a dogwood; thence
leaving said line, S. 84 W., 12 poles to a whiteoak, corner to the Mary Burkhammer tract of land; and
thence by a line of same, N. 89 W., 28 poles to a hickory and black oak; S. 5 W., 54 poles to a stake; S 20
E.. 69 poles to a stone pile on top of ridge; one pole from a chestnut tree, corner to Susan Martin land;
thence N. 83 E., 26 poles; S. 66 E., 12 poles to the beginning, containing 31 acres, more or less.
Being the same real estate conveyed unto Darrell Lee Murphy by Cheryl Pritt Woods and Carlotta
Pritt by Deed dated March 28, 2002, and of record in the Office of the Clerk of the County Commission
of Clay County, West Virginia, in Deed Book 188, at Page 1129.
SECOND TRACT: 63 acre tract:
BEGINNING at a stake, corner to the Monahan 500 acre tract and also a corner to the Tanner 34-acre
tract, and running thence S. 49 W., 56 poles to an ash (now gone), S. 13 ½ W., 21 ½ poles to the top
of Smith Knob, S. 82 W., 50 poles to stake in the Tim Martin line, N 7 ½ W., 92 poles to two hickorys,
corner to Davis Perry Mollahan lands, S. 56 E., 14 poles to chestnut oak; S. 70 ½ E., 38 ½ poles to
stake, S. 15 ½ E., 18 poles to chestnut oak, S. 31 E.,34 poles to the place of beginning, containing
sixty-three (63) acres, more or less.
Being the same real estate conveyed unto Darrell Lee Murphy by Garnet S. Roger and Lonnie E. Rogers, her husband, by Deed dated the 23rd day of May, 1997, of record in the Office of the Clerk of the County Commission of Clay County, West in Deed Book 174, at Page 729.
The address of the property is 2990 Clinic Drive, Chloe, WV 25235, and the property is shown as Parcels 4 and 27, on Tax Map 5, in Otter District, Clay County, West Virginia.
This conveyance will be made by Special Warranty Deed, subject to any special assessments, unpaid taxes, restrictions, conditions, reservations, exceptions, easements and provisions as set forth in the chain of title to the aforesaid property. The property is sold in “as is” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
Pursuant to the terms of said deed of trust, the Trustee may postpone the sale by public announcement at the time and place designated for the sale.
TERMS OF SALE: Cash on hand on date of sale.
