ORDER OF PUBLICATION TO: Gregory “Scott” Lewis, II The object of the above styled civil action is to sell the real estate of a decedent under West Virginia Code 44-8-7 and for declaratory judgment under West Virginia Code 55-13-4 for instructions to a fiduciary concerning the interpretation and construction of a will. It appearing from an Affidavit filed in this civil action that Petitioner has diligently attempted to make service of process on Respondent Gregory “Scott” Lewis, II, that service of process has failed to be served on Respondent, and that an order of publication may be entered against him pursuant to Rule 4 of the West Virginia Rules of Civil Procedure, it is therefore ORDERED that the above named parties appear within thirty (30) days after the date of the first publication hereof and serve a written answer to the Petition upon Petitioner’s counsel, John J. Brewster, Esq., Ray, Winton & Kelley, PLLC, 109 Capitol Street, Suite 700, Charleston, West Virginia 25301. Otherwise, judgment by default may be taken against the above-named parties in accordance with law.
