NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by the virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated July 9, 2007, executed by the Borrowers, Larry D. Bradford and Marcella A. Bradford, to Janet Phillips, the Trustee, of record in the Office of the Clerk of the County Commission of Nicholas County, West Virginia, in Book 386, at Page 202. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 5890 Scenic Highway, Summersville, WV 26651. Pill & Pill, PLLC was appointed as Substitute Trustee by a SUBSTITUTION OF TRUSTEE dated May 29, 2024, of record in the Clerk’s Office in Book 541, at Page 424. The Borrowers defaulted under the Note and Deed of Trust and the Substitute Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustee will sell the following described property to the highest bidder at the front door of the Courthouse of Nicholas County, in Summersville, West Virginia on the following date: August 20, 2024, at 2:45 p.m. All that certain lot or parcel of real estate together with any buildings or improvements thereon, situate in Hamilton District, Nicholas County, West Virginia, more particularly bounded and described as follows, to-wit: Parcel No. 1: Beginning at an iron pipe on the western edge of the right of way of West Virgina State Route No. 43, a corner to the Frank Justice Estate; thence leaving said right of way and with said Justice, and three lines of Ray Sparks’ 29.49 acre tract, N. 83 degrees 20 minutes W 446.70 feet to a fence post, a corner to Justice; thence continuing with Justice N 1 degree 56 minutes E 35 feet to a stake; thence N 0 degrees 15 minutes E 70.9 feet to a stake, witness by a four inch maple bearing 2 feet S 65 degrees E; thence leaving Justice and through said 29.49 acre tract N 74 degrees 15 Minutes E 513.5 feet to an iron pin at the edge of said right of way; thence with same S. 10 degrees 1 minute W 295.8 feet to the beginning, containing 2.8 acres, more or less. Parcel No. 2: Beginning at an iron stake in the westerly edge of State Route No. 43, the northeasterly corner of that certain tract of land conveyed to Bernell Sparks and Freda Smallwood Sparks of record in the Office of the Clerk of the County Court of Nicholas County in Deed Book 168, Page 438, and running thence S 7 degrees 35 minutes W 41.4 feet to a point where formerly was the corner of a fence; thence S 79 degrees 45 minutes W approximately 500 feet to the point in the extension of the back or westerly line of the land conveyed by O. Ray Sparks and wife by deed aforesaid, thence S 0 degrees 15 minutes W approximately 94 feet to a stake, the northwest corner of the said land so conveyed by O. Ray Sparks and wife, thence with the northerly line thereof reversed S 74 degrees 15 minutes W 513 feet to the place of beginning, containing 781/800 acre, more or less. However, there is excepted, reserved and not hereby conveyed from the above described parcels of real estate 6568 square feet, more or less. Being the same fee simple property conveyed by deed from Roger Lee Spinks and Deborah Ann Spinks, husband and wife, to Larry D. Bradford and Marcella A. Bradford, husband and wife, joint tenants, dated 05 61/8994, recorded on 61/431/8994 in Book 0357, Page 380 in Nicholas County Records, State of WV. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-2-1. 3) The Beneficiary and r Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and r belongings remaining at the property after foreclosure sale will be deeded to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee within thirty (30) days of the sate of sale, with ten percent (10%) of the total purchase price payable to the Trustee at sake, Pill & Pill, PLLC, Substitute Trustee Jonathan L.
