NOTICE OF FILING OF PETITION FOR
FORFEITURE
The object of this suit is to seek an order forfeiting the herein-described forfeited property pursuant to the West Virginia Contraband Forfeiture Act (West Virginia Code, §60A-7-701 et seq.).
IN THE MATTER OF OHIO COUNTY CASE NUMBER 23-P-197, CRYSTAL RUTAN AND JOHN A. MARPLE, or any claimant of a right or interest in the property described herein, you have the right to file a claim or interest in the Twenty Thousand Four Hundred Dollars ($20,400.00) in United States Currency that was claimed by the Ohio Valley Drug Task Force on or about July 20, 2023, incident to a consent search of a black Lincoln automobile driven by Crystal Rutan, and a probable cause search of John A. Marple, an occupant of the vehicle, on Chapline Street near the intersection with 12th Street in Wheeling, Ohio County, West Virginia, following a traffic stop Wheeling Police Department. Anyone filing a claim on said described property shall do so on or before August 22, 2024, or not less than thirty days from the date of the first publication, whichever is longer. Any such claim must clearly state the identity of the claimant and an address where legal process can be served upon said claimant.
Let it be known that anyone seeking a copy of the Petition may obtain a copy of the Petition from the Clerk of the Circuit Court of Ohio County, West Virginia.
After the date for filing of any said claims(s) has passed, an order of the Court directing forfeiture of the seized property and vesting ownership of said property in the State shall be sought and may be entered by the Court.
The confiscated money is subject to administrative forfeiture unless you provide a written notice to file a claim on or before the date set forth above or within thirty days from the date of the first publication. Said notice shall clearly state the identity of the claimant and list an address where legal process can be served.
If you fail to file a claim the Court may enter an order granting the relief demanded in the instant Petition.
