NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the Summers County Commission.
REQUEST FOR RELEASE OF FUNDS
On or after August 16, 2024, the Summers County Commission will submit a request to the West Virginia Development Office for the release of Housing and Urban Development (HUD) Community Development Grant 20CDBG0011 funds under Title I of the Housing and Community Development Act of 1974, as amended, to undertake the following project:
Project Title: Broomstraw Road/Mark Meador Road Waterline Extension
Purpose: To provide public water service to approximately fifty-three (53) customers impacted by poor water quality and quantity issues via construction of approximately 49,980 linear feet of 8-inch and smaller diameter waterlines, a 100,000-gallon water tank, a 100 gallons per minute booster station, a pressure reducing station, fire hydrants, valves, and other related appurtenances.
Location: Along portions of Broomstraw Road, Broomstraw Ridge Road, Mark Meador Road, Fellside Lane, Robins Roost Road and adjacent adjoining roads of Summers County, West Virginia.
Estimated Cost: The total estimated project cost is $7,445,000 of which $1,663,158 is HUD Community Development Block Grant funding.
FINDING OF NO SIGNIFICANT IMPACT
The Summers County Commission has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at Summers County Commission c/o Region I Planning & Development Council, 241 Mercer Springs Road, Suite 21, Princeton WV 24740 and may be examined from 8:30 AM until 4:30 PM weekdays by appointment only (304) 431-7225.
PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on the ERR to the Summers County Commission c/o Region I Planning & Development Council, 241 Mercer Springs Road, Suite 21, Princeton WV 24740. Attn: Charles Saunders, President. All comments received by August 15, 2024 will be considered by the Summers County Commission prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.
RELEASE OF FUNDS
The Summers County Commission certifies to the West Virginia Department of Economic Development that Charles Saunders in his capacity as President consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. West Virginia Department of Economic Development approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the Summers County Commission to use HUD program funds.
OBJECTIONS TO RELEASE OF FUNDS
The West Virginia Department of Economic Development will accept objections to its release of funds and the Summers County Commission’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the Summers County Commission; (b) the Summers County Commission has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by the West Virginia Department of Economic Development; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to Attention: Ryan Halsey, CDBG Programs Manager, WV Department of Economic Development at 1900 Kanawha Blvd. East, Building 3, Suite 700, Charleston, WV 25305. Potential objectors should contact WV Department of Economic Development to verify the actual last day of the objection period.
