NOTICE OF SPECIAL MEETING
ON PROPOSED SALE OF
REAL ESTATE OF
CATAWBA CEMETERY FUND INCORPORATED

TO: The Members of the Board of Directors of the Catawba Cemetery Fund Incorporated and All Cemetery Lot Owners

The Board of Directors of the Catawba Cemetery Fund Incorporated will hold a special meeting for purposes of adopting the following resolution:

RESOLUTION

A RESOLUTION OF THE BOARD OF DIRECTORS OF THE CATAWBA CEMETERY FUND INCOPORATED PROVIDING FOR AND AUTHORIZING THE SALE, TRANSFER AND CONVEYANCE OF A CERTAIN PARCEL OF REAL ESTATE SITUATE IN WINFIELD DISTRICT, MARION COUNTY, WEST VIRGINIA, TO-WIT:

FROM THE CATAWBA CEMETERY FUND INCOPORATED TO MCKAGNEY, LLC, A NORTH CAROLINA LIMITED LIABILITY COMPANY; AND AUTHORIZING THE PRESIDENT AND SECRETARY/TREASURER TO EXECUTE AND DELIVER ALL TRANSACTIONAL DOCUMENTS, INCLUDING THE DEED OF CONVEYANCE, ON BEHALF OF THE CORPORATION.

If adopted, this resolution will authorize, approve, provide for and direct the sale, transfer and conveyance of the above-described parcel of real estate by Catawba Cemetery Fund to McKagney, LLC, a North Carolina limited liability company, pursuant to that certain Real Estate Purchase Agreement dated July 1, 2024. The total consideration to be paid to Catawba Cemetery Fund Incorporated by McKagney, LLC for the real estate to be conveyed by is $20,000.00.

The Special Meeting for the above stated purpose will be held on Monday, August 5, 2024, at 5: 00 p.m., or as soon thereafter as the matter may be heard, at 432 Catawba Road, Fairmont, Marion County, West Virginia (Pavilion across from Catawba Church).

The object of the above entitled action is to obtain judgment for a debt.
And it appearing by an affidavit filed in this action that it appearing by an Affidavit of Unknown Residency filed in this action that due diligence has been used to ascertain the address or whereabouts of Jeremy Kirchner, and all efforts have been in vain. Therefore it is ordered that Jeremy Kirchner do serve upon Greg Tanner, magistrate, whose address is 222 Main Street, First Floor, Beckley, WV 25801, an answer or other defense to the complaint filed in this action on or before Friday, 16th August 2024, at 6:00 pm, otherwise judgment by default will be taken against Jeremy Kirchner at any time thereafter. A copy of said complaint can be obtained from the undersigned Clerk at her office.
