TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated April 23, 1993, and duly recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Document No. 274029, in Book No. 2097, at Page 979, Louise M Tinsley and Emmitt L Tinsley did convey unto John Neuner III and Rodney B. Frye, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by The Huntington National Bank to foreclose thereunder, will offer for sale at public auction at the front door of the Kanawha County Courthouse in Charleston, West Virginia, on August 27, 2024 at 11:00 AM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 25 – Union District, Kanawha County, West Virginia, and more particularly described as follows: All that certain lot and parcel of land, together with the improvements thereon and appurtenances thereunto belonging, situate in Union District, Kanawha County, West Virginia, and being a part of the east part of Lot No. 16 of the Flatwoods Farms, which was acquired by the first parties from Grant P. Hall, Jr., Trustee in Bankruptcy, by deed of February 17, 1940, and recorded in the Office of the Clerk of the County Court of Kanawha County, West Virginia, in Deed Book 530, Page 177, the property hereby conveyed being described as follows, to-wit: Beginning at an iron pipe in the southerly line of a county road known as Kelly Road, and running thence S. 29 05 W. 139.9 feet to an iron pin; thence N. 52 25 W 59.55 feet to an iron pin; thence N. 1 50 E. 146.54 feet to an iron pin; thence S 66 40 E. 99 feet to the place of beginning, containing 0.25 acre, which property has been surveyed and is shown upon a plat hereto attached and expressly made a part hereof, and reference is made to the deed aforesaid. Grantors promise and agree not to transfer legal or equitable title to the property hereby conveyed without obtaining written consent to such transfer from the beneficial owner or holder of the debt hereby secured. Any notice of foreclosure, or other notice required hereunder, or by the laws of the State of West Virginia, shall be served upon the grantor, Louise H. Tinsley and Emmitt L. Tinsley, at 5285 Kelly Road, Cross Lanes, West Virginia, 25313, pursuant to Chapter 38, Article 1, Section 4, of the Code of West Virginia. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 5285 Kelly Road, Cross Lanes, WV 25313. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. LEGAL NOTICE Sealed proposals will be received by the Rome Township Trustees, until 2:00 P.M. Eastern Time on August 26, 2024, and will be opened and read immediately thereafter at the office of the Rome Township Trustees, 9644 County Road 107, Proctorville, Ohio 45659 for the: Rome Township Paving Improvements Township Road 172N Township Opinion of Probable Cost: $145,000 Completion Date – 60 days from Notice to Proceed This project consists of the placement of asphalt pavement on Township Road 172N of Rome Township. The road is approximately 6,800 feet in length and 14 feet wide. This shall be bid on a unit price basis. Proposals mailed prior to the bid opening date shall be sent to Rome Township Trustees, 506 County Road 411, Proctorville, Ohio 45659 and must be delivered prior to bid opening date and time. Proposals may be hand delivered on the date of bid opening to the office of the Rome Township Trustees, 9644 County Road 107, Proctorville, Ohio 45659.
