Notice is hereby given that PERFORMANCE COAL COMPANY, LLC, PO BOX 457, 370 PACKSVILLE/MARFORK ROAD, WHITESVILLE, WV 25209 has submitted an application with the Department of Environmental Protection (DEP), 1159 Nick Rahall Greenway, Fayetteville, WV, 25840 for a Phase 1 and 2 release on Permit Number U306087 issued for 18.07 acres.
The permit is located in Marsh Fork District of Raleigh County, 3 miles southwest (Direction) of
Naoma (Nearest PO) on Hazy Creek (Primary Receiving Stream) of Marsh Fork of Big Coal River
(Secondary Receiving Stream) of Coal River (Major Drainage Basin).
PERFORMANCE COAL COMPANY, LLC completed revegetation on 11/17/2021 and is requesting release of 60 percent of the reclamation performance bond in the amount of $19,000.00. For Phase 1 release and 25 percent of the reclamation performance bond currently in the amount of $19,000.00 for phase 2 release.
Written comments will be received at the DEP address above until 9/20/2024, or thirty (30) days from date of final publication.
