NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated April 8, 1993, executed by Borrower, Dorothy E Smith, to James L. Whytsell and Phyllis H. Arnold , the Trustee of record in the office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Book 336, at Page 521. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 208 Crowfield Circle n/k/a 681 Crowfield Circle, Lewisburg, WV 24901. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated February 15, 2023, of record in the Clerk’s Office in Book 878, Page 603. The borrower defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Greenbrier County, in Lewisburg, West Virginia, on the following date:

23rd day of July, 2024

at 12:00 p.m.

All that certain tract or parcel of land being Lot 12, Crowfields, situate in the City of Lewisburg, Greenbrier County, West Virginia and more particularly bounded and described as follows: Beginning at a 1/2” re-bar found in the eastern R/W of Crowfield Circle, a corner to Lot 11; thence leaving Lot 11 and with said R/W and a curve to the right having a radius of 806.95 feet, an arc distance of 88.07 feet and whose chord bears N 37° 54’ 07” E 88.02 feet to a 1/2” re-bar found, a corner to Lot 13; thence leaving Crowfield Circle and with said Lot 13 S 44° 25’ 00” E 187.11 feet to a 1/2” re-bar found in the western boundary line of Harvey M. Cudd; thence leaving Lot 13 and with said Cudd S 43° 55’ 40” W 72.00 feet to a 1/2” re-bar found, a corner to Lot 11; thence leaving Cudd and with said Lot 11 N 49° 20’ 00” W 178.08 feet to the place of beginning and containing 0.336 acre, more or less, according to a survey made by N. Eugene Kelley on March 19, 1993, and shown on plat entitled “Plat Showing the Property of Dorothy E. Smith” attached hereto and made a part of this description. And being the same property conveyed unto Dorothy Elizabeth Smith, single, by Deed from J. P. R. Construction Company, Inc., a West Virginia corporation, dated May 6, 1992, of record in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia in Deed Book 413, at Page 111 and previously described as follows: “All of that certain tract or parcel of land designated as Lot 12, Crowfields Subdivision, as more fully shown on a map entitled “CROWFIELDS PHASE ONE” which was surveyed by Greenbrier Surveying Co., Inc., Lewisburg, W. Va. in April 1982 and revised in May 1987, said plat recorded in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia in Map Book 4, at Page 5A8”.

Being the same property conveyed to Dorothy E. Smith by the Deed dated May 6, 1992 and recorded in Deed Book 413 at Page 111 in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia.

TERMS OF SALE:

1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
