TOWN OF MATEWAN MINGO COUNTY, WV RED JACKET SANITARY SEWER UPGRADE PROJECT ADVERTISEMENT FOR BIDS Sealed Bids for the construction of: Red Jacket Sanitary Sewer Upgrade Project Furnishing all materials, labor, and necessary items for the construction and installation of approximately 23,790 LF of 8″ and smaller diameter gravity sewer line; 167 wastewater manholes; cleanouts, service laterals and all other items and appurtenances as outlined in the Plans and Specifications. Sealed Bids for the construction of the Red Jacket Sanitary Sewer Upgrade Project will be received by the Town of Matewan at City Hall, located at 617 East Third Avenue, Matewan, West Virginia, 25678 until 1:00 p.m. local time on October 9, 2024, at which time the Bids received will be publicly opened and read. A mandatory pre-bid meeting will be conducted at the Town of Matewan City Hall at 10:00 a.m. on September 26, 2024. Attendance at the pre-bid meeting is mandatory. Bidders who return full sets of the Bidding Documents in good condition (suitable for re-use) within 30 days after receipt of Bids will receive a full refund. Checks for Bidding Documents shall be payable to “E.L. Robinson Engineering Company”. Upon request and receipt of the document deposit indicated above, the Issuing Office will transmit the Bidding Documents via delivery service. The date that the Bidding Documents are transmitted by the Issuing Office will be considered the Bidder’s date of receipt of the Bidding Documents. Partial sets of Bidding Documents will not be available from the Issuing Office. Neither Owner nor Engineer will be responsible for full or partial sets of Bidding Documents, including Addenda if any, obtained from sources other than the Issuing Office. Bid security shall be furnished in accordance with the Instructions to Bidders. DBE REQUIREMENTS Each Bidder must fully Comply with the Disadvantaged Business Enterprises, and Affirmative Action Requirements, as identified in the contract documents. The Bidder agrees to make “positive efforts” to subcontract a portion of the total value of the contract to Disadvantaged Business Enterprises. This shall be done in compliance with the six (6) affirmative steps as outlined in 40 CFR 33.240. Failure to demonstrate positive efforts to do so may lead to rejection of bids. For this program, the term “subcontract” includes all construction, modification, and service work contracted for by the bidder in the execution of the work under this contract. NONDISCRIMINATION IN EMPLOYMENT This project is to be funded by a grant from the Community Development Block Grant (CDBG) Program, a grant from the Appalachian Regional Commission (ARC) and funding from the United States Department of Agriculture, Rural Utilities Service, and shall be referred to as the Red Jacket Sanitary Sewer Upgrade Project. The work to be performed under this contract is subject to the requirements of Section 3 of the Housing and Urban Development Act of 1968, as amended, 12 U.S.C. 170I u (Section 3). The purpose of Section 3 is to ensure that employment and other economic opportunities generated by HUD assistance or HUD-assisted project covered by Section 3, shall, to the greatest extent feasible, be directed to low- and very low-income persons, particularly persons who are recipients of HUD assistance for housing. The parties of this contract agree to comply with HUD’s regulations in 24 CFR Part 135, which implement Section 3. Bidders’ attention is directed to the Section 3 “Clause” set forth in the contract documents. Bidders on this work will be required to comply with the President’s Executive Order No. 11246 entitled “Equal Employment Opportunity” as amended by Executive Order No. 11375 and “HUD Section 109,” which prohibits discrimination in employment regarding race, creed, color, sex or national origin. Bidders much comply with Title VI of the Civil Rights Act of 1964, the Davis-Bacon Act, the Copeland Anti-Kickback Act, the Contract Work Hours and Safety Act, the West Virginia Division of Labor Wages for Construction of Public Improvements pursuant to West Virginia Code 21-5A-3, West Virginia Jobs Act (West Virginia Code 21-1C-1) and the Drug-Free Workplace Provisions pursuant to West Virginia Code 21-1D-5. No Bidder may withdraw their bid for a period of ninety (90) days after the time of the opening of the Bids. Any Contractor submitting a Bid on this project hereby certifies, indicates, and acknowledges that he has a license and meets all the qualifications required by the statutes of the State and subdivision in which the work is to be performed. The Contractor shall comply with the West Virginia Contractor Licensing Act and shall require all subcontractors to comply with that Act. A Contractor’s License Number is to be included on the bid submission. Pursuant to West Virginia Code 5-22-2, requirements stated in the advertisement for bids and the bid form may not be waived by any public entity. “Section 746 of Title VII of the Consolidated Appropriations Act of 2017 (Division A – Agriculture, Rural Development, Food and Drug Administration, and Related Agencies Appropriations Act, 2017) and subsequent statutes mandating domestic preference applies an American Iron and Steel requirement to this project. All listed iron and steel products used in this project must be produced in the United States. The term “iron and steel products” means the following products made primarily of iron or steel: lined or unlined pipes and fittings, manhole covers and other municipal castings, hydrants, tanks, flanges, pipe clamps and restraints, valves, structural steel, reinforced precast concrete, and construction materials. The deminimis and minor components waiver apply to this contract.” Domestic Preference This project is subject to the Build America, Buy America Act (BABAA) requirements under Title IX of the Infrastructure Investment and Jobs Act (IIJA), Pub. L. 117-58, 70901-70953. Absent an approved waiver, all iron, steel, manufactured products, and construction materials used in this project must be produced in the United States.
