NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated October 10, 2008, executed by Borrower(s), Gerald C. Boggs and Cecilia R Boggs, to Phillip Hereford, the Trustee of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia, in Book 3603, at Page 289. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 1017 Greenland Cir, South Charleston, WV 25309. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated November 13, 2023, of record in the Clerk’s Office in Book 4678, Page 617. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Kanawha County, in Charleston, West Virginia, on the following date: 9th day of October, 2024 at 11:45 a.m. Situate in The City of South Charleston, Jefferson District, Kanawha County, West Virginia, being all of Lot 408 as said lot is shown upon a map entitled, “Map Showing Section Four, Armor View Addition Part of the Former Booker Washington Park Located Adjacent to the City of South Charleston Jefferson, Kanawha County, W. Va.”, dated June 1, 1972, made by Lilly Engineering & Surveying Co., and of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Map Book 24, at pages 64 and 65. This conveyance is made subject to the restrictive covenants and reserved rights, privileges and easements contained in the deed for Lot No. 401 of said Section Four of Armor View Addition from Charleston Realty Company, a corporation, to R. L. Bumgardner Contractor, Inc., a corporation, dated March 15, 1971, and of record in said Clerk`s Office in Deed Book 1648, at page 362. This conveyance is made and accepted subject to the easement conveyed by Charleston Realty Company, a corporation, to The Chesapeake and Potomac Telephone Company of West Virginia, a corporation, by deed dated June 21, 1972, and of record in said Clerk`s Office in Deed Book 1665, at page 44. The parties of the first part do hereby assign, transfer and set over unto the parties of the second part one membership in the Armor View Property Owners Maintenance Association, a nonprofit West Virginia corporation, together with all of the rights, privileges and obligations of such membership. The parties of the second part for themselves, their heirs and assigns, by accepting this deed, accept such membership and agree to be bound by the provisions of the charter and by-laws of the said Armor View Property Owners Maintenance Association as the same are now written or as they may hereafter be amended. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 3) The Beneficiary and r the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and r belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
