WASTEWATER SYSTEM IMPROVEMENTS

General Notice

The Central Hampshire PSD (Owner) is requesting Bids for the construction of the following Project:

WASTEWATER SYSTEM IMPROVEMENTS

Bids for the construction of the Project will be received at the Central Hampshire PSD office located at 18540 Northwestern Pike Augusta, WV 26704 until 11 a.m. local time on October 11, 2024, at which time the Bids received will be publicly opened and read.

Bids will be received for each contract until the scheduled opening time for that contract.

Any contract or contracts awarded under this invitation for bids are expected to be funded in part by grants and loans from: the West Virginia Department of Environmental Protection State Revolving Fund; USDA Rural Development; West Virginia Infrastructure and Jobs Development Council. Neither the United States, the State of West Virginia nor any of their departments, agencies or employees are or will be a party to this invitation to bid or any resulting contract.

Bidders must comply with all applicable laws and regulations for construction projects receiving Federal aid including, but not limited to, the Davis-Bacon Act as amended.

The method of bidding will be as follows:

CONTRACT #1 – Frenchburg Wastewater Treatment Plant Improvements:

Lump sum to construct the Wastewater Treatment Plant consisting of all work necessary to construct a 200,000 gpd Sequencing Batch Reactor (SBR) wastewater treatment plant on an existing wastewater treatment site including an influent submersible sewage lift station, headworks building including the existing mechanical screen, rehabilitated and reinstalled in the new channel, and grit removal chamber, primary treatment facilities housed in rectangular concrete tanks, ultraviolet disinfection channel, Parshall flume, converting the existing clarifier to a sludge holding tank, site piping, miscellaneous electrical work, access road, fencing, landscaping, demolition of existing lift station, treatment basins, sludge holding basin, converting the existing headworks building to a storage building and other incidental work required for a complete operating wastewater treatment plant.

Construction of one (1) lift station consisting of precast concrete structures, piping, pump installation, demolition of an existing lift station and concrete package plant, 4,760 feet of 6” force main, and tie-into new manhole on existing gravity sewer line, install concrete valve vault and replace flow meter at the High School lift station, landscaping, fencing and other incidental work required for a complete lift station and force main installation.

CONTRACT #2 – Wastewater System Rehabilitation:

Unit price contract to install 35 new manholes, rebuild 23 inverts, 156 vf of manhole sealings, replace 39 new castings, locate and raise 13 manholes, repair 9 cleanouts, 18 manhole root removals, rehabilitation of two (2) existing lift stations, and other work required to provide a complete rehabilitated wastewater system.

Prospective Bidders may examine the Bidding Documents at the Issuing Office on Mondays through Fridays between the hours of 8:00 a.m. – 5:00 p.m. and may obtain copies of the Bidding Documents from the Issuing Office as described below.

The date that the Bidding Documents are transmitted by the Issuing Office will be considered the Bidder’s date of receipt of the Bidding Documents. Partial sets of Bidding Documents will not be available from the Issuing Office. Neither Owner nor Engineer will be responsible for full or partial sets of Bidding Documents, including Addenda if any, obtained from sources other than the Issuing Office.

A five percent (5%) Bid Bond or certified cashier’s check must accompany all bids.

Prospective Bidders should note that [these/this] contract(s) will include the following critical requirements as identified in the contract documents:

1. Certification of EEO Compliance

3. If Bid amount exceeds $10,000, signed Compliance Statement (RD 400-6). Refer to specific equal opportunity requirements set forth in the Supplementary Conditions of the Construction Contract (EJCDC C-800)

6. WV Contract Licensing Act – All bidders are required to have a WV Contractor’s License per Section 30-42-12 of the WV Code.

Contractors are required to comply with all laws pertaining to the federal wage rates issued in accordance with the Davis Bacon Act.

Each bid must be submitted at the time and place indicated above and must be submitted using a two envelope system. Two separate and distinct envelopes each with proper identification must be enclosed in a large opaque sealed bidding envelope, marked with the Project Title, and name and address of the Bidder. These envelopes shall be identified as “Bid Opening Requirements” and “Bid Proposal.”

The “Bid Opening Requirements” envelope shall contain the completed required documents listed above. The “Bid Proposal” envelope shall contain solely the Completed Bid Form. If the Bid is sent through the mail or other delivery system the entire bidding package must be enclosed in a separate envelope addressed to the Owner with the notation “Bid Enclosed” on the face thereof.

At the scheduled time, Bids will be opened publicly. The “Bid Opening Requirements” envelope and the “Bid Proposal” envelope will be removed from the bidding envelope of each Bidder. The “Bid Opening Requirements” envelope and “Bid opening Requirements Checklist” will first be opened and the contents will be checked for completeness. In the event that all of the items are not complete from the first envelope the “Bid Proposal” envelope shall be returned to the Bidder unopened and the Bid will be considered non-responsive. This requirement will not be waived for any reason. After determination that all items in the Bid Opening Requirements envelope are complete the “Bid Proposal” envelope will be opened publicly and real aloud.

The Contracts have the following completion times from the date the work will commence in accordance with the Notice to Proceed, and daily liquidated damage amounts for each calendar day that expires that a Contract is not completed after the scheduled completion dates:

Contract 1:

Substantial Completion: 360 days after the date of commencement

Final Completion: 390 days after the date of commencement

Liquidated Damage: $1,600 per calendar day

Contract 2:

Substantial Completion: 120 days after the date of commencement

Final Completion: 150 days after the date of commencement

Liquidated Damage: $1,000 per calendar day

Instructions to Bidders.

For all further requirements regarding bid submittal, qualifications, procedures, and contract award, refer to the Instructions to Bidders that are included in the Bidding Documents.

No Bidder may withdraw his bid within 90 days after the actual date of the opening thereof. The Owner reserves the right to reject any or all bids.

The Central Hampshire PSD is exempt from West Virginia state sales and use taxes on materials and equipment to be incorporated in the Work. Said taxes must not be included in the Bid.

DBE REQUIREMENTS

Each bidder must fully comply with the Disadvantaged Business Enterprises, and Affirmative Action requirements, as identified in the contract documents. The Bidder agrees to make “positive efforts” to subcontract a portion of the total value of the contract to Disadvantaged Business Enterprises. This shall be done in compliance with the six (6) affirmative steps as outlined in 40 CFR 33.240. Failure to demonstrate positive efforts to do so may lead to rejection of bids. For this program, the term “subcontract” includes all construction, modification and service work contracted for by the bidder in the execution of the work under this contract.

NONDISCRIMINATION IN EMPLOYMENT

Bidders on this work will be required to comply with the President’s Executive Order No. 11246. The requirements for bidders and contractors under this order are explained in the specifications.

SUSPENSION AND DEBARMENT

Recipient shall not entertain the use of businesses that are listed on the “System for Award Management (SAM)” at www.sam.gov in accordance with 2 CFR Part 1532 and Subpart B and C of 2 CFR Part 180.

WV ALCOHOL AND DRUG FREE WORKPLACE ACT

WEST VIRGINIA CODE 21-1D-5 PROVIDES THAT ANY SOLICITATION FOR A PUBLIC IMPROVEMENT CONSTRUCTION CONTRACT REQUIRES EACH VENDOR THAT SUBMITS A BID FOR THE WORK TO SUBMIT AT THE SAME TIME AN AFFIDAVIT OF COMPLIANCE WITH THE BID. THE ENCLOSED DRUG-FREE WORKPLACE AFFIDAVIT MUST BE SIGNED AND SUBMITTED IN THE FIRST ENVELOPE AS EVIDENCE OF THE VENDOR’S COMPLIANCE WITH THE PROVISIONS OF ARTICLE 1D, CHAPTER 21 OF THE WEST VIRGINIA CODE. FAILURE TO SUBMIT THE SIGNED DRUG-FREE WORKPLACE AFFIDAVIT IN THE FIRST ENVELOPE SHALL RESULT IN DISQUALIFICATION OF SUCH BID.

NOTICE OF FEDERAL AND STATE WAGE REQUIREMENTS

Contractors are required to comply with all laws pertaining to federal wage rates as issued in accordance with the Davis Bacon Act. The contractor will be required to pay the federal wage rates appropriate for each worker classification.

DOMESTIC PREFERENCE

BUILD AMERICA, BUY AMERICA REQUIREMENT

P.L. 117-58, Infrastructure Investment and Jobs (IIJA) Act, 2021 (Act), includes a “Build America, Buy America (BABA)” requirement in Sections 70911 through 70917 that requires Clean Water State. Revolving Loan Fund (CWSRF) and Drinking Water State Revolving Loan Fund (DWSRF) assistance recipients to use iron, steel, manufactured products, and construction materials that are produced in the United States for projects for the construction, alteration, maintenance, or repair of a public water system or treatment works.

This project is subject to the Build America, Buy America Act (BABAA) requirements under Title IX of the Infrastructure Investment and Jobs Act (IIJA), Pub. L. 117-58, §§ 70901-70953. Absent an approved waiver, all iron, steel, manufactured products, and construction materials used in this project must be produced in the United States.
