COMBINED PUBLIC NOTICE THAT INCLUDES: (1) NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS (NOI RROF); AND (2) NOTICE OF FINDING OF NO SIGNIFICANT IMPACT (FONSI) DATE OF NOTICE: September 25, 2024 RESPONSIBLE ENTITY NAME: City of Huntington, WV RESPONSIBLE ENTITY ADDRESS: 800 5th Avenue Huntington, WV 25701 TELEPHONE: 304-696-5540 Ext. 2104 TO ALL INTERESTED AGENCIES, GROUPS AND PERSONS: The purpose of this notice is to satisfy two (2) separate but related procedural notification requirements for an activity to be undertaken by the Huntington West Virginia Housing Authority (HWVHA). (1) NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS (NOI-RROF) On or about October 11, the City of Huntington, WV, as the Responsible Entity (RE) will authorize the Huntington West Virginia Housing Authority (HWVHA) to submit a request to the U.S. Department of Housing and Urban Development (HUD) for consent under Title I of the United States Housing Act of 1937, as amended, to undertake a project known as Northcott Court Disposition to enable the disposition of the subject property and the redevelopment of the previously demolished and cleared former HWVHA Northcott Court public housing community. ASSESSED PROJECT Huntington West Virginia Housing Authority (HWVHA) – Former Northcott Court Disposition: The proposed activity provides for the disposition of the subject property and the redevelopment of the previously demolished and cleared former Huntington Housing Authority’s Northcott Court public housing community. The site is located along the eastern side of Hall Greer Boulevard bound by Doulton Avenue to the north, Northcott Court to the east, and Charleston Avenue to the south in Huntington, Cabell County, West Virginia. The site encompasses approximately 3.972 acres that is currently owned by the Huntington West Virginia Housing Authority (HWVHA) and recorded in Deed Book 306, Page 177, on file at the Cabell County Courthouse located in Huntington, West Virginia. No federal funds or non-federal funds will be used in the disposition of the subject property. Disposition of the property is anticipated to be completed during Calendar Year 2024. (2) NOTICE OF FINDING OF NO SIGNIFICANT IMPACT (FONSI) The City of Huntington has determined that the above-identified activity will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. The subject activity is assessed under HUD regulations at 24 CFR Part 58 from NEPA requirements. Additional activity information is contained in the Environmental Review Record (ERR) on file at the City of Huntington, Office of Planning and Development, 800 5th Ave L39, Huntington, WV 25701, and is available for public examination and copying, upon request, during normal business hours weekdays, 8 a.m. to 4:30 p.m. PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the ERR by mail to the City of Huntington Department of Planning and Development, 800 5th Ave, Huntington, WV 25701 or via email to: [email protected]. All comments received by October 10, 2024 will be considered by the City of Huntington prior to authorizing submittal of a request for consent to HUD. Commenters should specify which Notice provided herein they are addressing. ENVIRONMENTAL CERTIFICATION The City of Huntington certifies to HUD that Steve Williams, Certifying Officer, in his capacity as Mayor, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process, and these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Huntington (Responsible Entity) and the Huntington West Virginia Housing Authority (HWVHA) to use HUD funds. OBJECTIONS TO RELEASE OF FUNDS HUD will accept objections to its release of funds and the City of Huntington’s certification for a period of fifteen (15) days following the anticipated submission date or its actual receipt of the request for consent (whichever is later) only if they are on one of the following basis: (a) the certification was not executed by the Certifying Officer of the City of Huntington; (b) the City of Huntington has omitted a step or failed to make a decision or finding required by HUD regulations are 24 CFR Part 58; (c) the City of Huntington or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the proposed activity is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with required procedures (24 CFR Part 58, Section 58.76), and shall be addressed to the Director of the Office of Public Housing, Baltimore Field Office, via email to [email protected]. Potential objectors should contact HUD to verify the actual last day of the objection period.
