TRUSTEE’S SALE OF VALUABLE REAL ESTATE

The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated May 28, 2015, and duly recorded in the Office of the Clerk of the County Commission of Hampshire County, West Virginia, in Deed of Trust Book 585, at Page 245, Joseph L. Dawson and Dawn M. Carroll did convey unto William C. Keaton and/or Julie A. Frazer, Trustees, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Hampshire County Courthouse, in Romney, West Virginia, on

October 21, 2024, at 9:30 AM

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Springfield District, Hampshire County, West Virginia, and more particularly described as follows:

All that certain tract of real estate situate in Springfield District of Hampshire County, West Virginia, together with any and all improvements, easements and appurtenances thereunto belonging, including all mineral rights and oil and gas rights, being all the same tract or parcel of real estate which was conveyed unto David Eugene McDonald by deed of M. Stella Woodson dated August 21, 1970, and of record in the Office of the Clerk of the County Commission of Hampshire County, West Virginia, in Deed Book No. 189, at Page 59, and described in said deed more fully as follows:

“Beginning at the intersection of the Cottage Road and the Secondary County Road and following the Secondary County Road in a westerly direction and following said road for a distance of 362 feet to turn in said road; thence in a Southerly direction for a distance of 281 feet; thence in a Southeast direction 156 feet to Drain; thence following Drain in an Easterly direction to Cottage Road; thence in a Northwesterly direction along Cottage Road for a distance of 300 feet to point of beginning.”

Said real estate is further depicted on the 2014 Hampshire County Land Books as District 10, Tax Map 17, Parcel 24.9, and as containing 1.72 acres, more or less.

And being the same real estate conveyed unto Joseph L. Dawson and Dawn M. Carroll, by deed of Susan T. Schumaker-Platt and Ronald B. Platt, her husband, dated the 28th day of May, 2015, and to be recorded prior to or contemporaneously with the recordation of this instrument in the Office of the Clerk of the County Commission of Hampshire County, West Virginia.

Pursuant to Chapter 38, Article 1, Section 4, of the West Virginia Code, any Notice of Trustee’s sale shall be mailed to the grantor (s) hereunder at the following address; or such other address subsequently given to the beneficiary in writing by the grantor (s):  65 Rose Hill Drive, Kearneysville, WV 25430.

The Trustee’s fee is fixed as a commission of Six Percent (6%) upon the gross sale price of the property; however, in the event it becomes necessary to advertise the said real estate in the enforcement of this deed of trust, and the debt be paid prior to sale, then the grantor (s) shall pay a commission to the trustee of three percent (3%) of the amount of the debt remaining unpaid at the time of advertisement.

At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 14 Cottage Lane, Springfield, WV 26763.

AND BEING the same real estate which was conveyed to Joseph L. Dawson and Dawn M. Carroll, by Deed dated May 28, 2015, from Susan T. Schumaker-Platt and Ronald B. Platt, and recorded in the Office of the Clerk of the County Commission of Hampshire County, West Virginia, in Deed Book 529, at Page 593.

The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
