NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated August 6, 2019, executed by Borrower(s), Brittany Lynn Bailey and Katie Elaine Prinkey, to Clyde A. Smith, Jr., the Trustee of record in the office of the Clerk of the County Commission of Raleigh County, West Virginia, in Book 5070, at Page 0724. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 914 Teel Rd, Beckley, WV 25801. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Raleigh County, in Beckley, West Virginia, on the following date:

18th day of November, 2024 at 11:00 a.m.

The surface of that certain real estate located in the Town District, Raleigh County, West Virginia, and more particularly described as follows: BEING the surface of a parcel of land in Oakley Heights Addition, a map of which is recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, MB-3-38F, such parcel being shown on that certain map entitled “Map Showing Property of Herbert Edward & Hazel G. Snuffer to be Conveyed to James B. & Shirley Hildreth”, record in said Clerk`s Office in Deed Book 556, Page 458A, said parcel being more particularly located, bounded and described as follows: BEGINNING at a rebar (set) on the Eastern R/W of Teel Road. Being a comer of the John O. & Judy F. Butler (MR14-PG549) parcel of land. Thence with the line of the said Butler parcel of land; S. 70° 51` E. 221.05` to a corner post, being a corner of the W.M.D. Holliday, Jr. (515-537) parcel of land, on the boundary line of the Adolfo & Joyce Andrada ((527-517) parcel of land. Thence with the line of the said Andrada parcel of land; S. 13° 47` W. 81.00` to a rebar (set), being a corner of the Lawrence C. & Janie L. Thomas (MR 46-PG 1287) parcel of land. Thence with the line of the said Thomas parcel of land; N. 73 ° 40` W. 213.56` to a rebar (set), at the R/W of Teel Road. Thence with the R/W of Teel Road; N. 09° 36` E. 92.42` to the point of beginning, containing 0.430 acres, more or less as surveyed by Engineering Services, Inc., Beckley, WV, in June of 1998. And being the same property conveyed to Brittany Lynn Bailey and Katie Elaine Prinkey by Deed dated the 5th day of August, 2019, from Carl S. Sansom and Melody E. Sansom, and to be recorded in the Office of the County Commission of Raleigh County, West Virginia, prior to or simultaneously herewith.

TERMS OF SALE:

1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes
imposed by the West Virginia Code § 11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note
reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property
from time to time by written or oral proclamation, which continuance
shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or
person occupying the property to vacate said property, and any
personal property and/or belongings remaining at the property after the
foreclosure sale will be deemed to constitute ABANDONED
PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee within thirty (30) days
of the date of sale, with ten (10%) of the total purchase price payable to
the Trustee at sale.
