NOTICE OF PUBLIC HEARING ON THE CITY OF HUNTINGTON COMBINED SEWER AND STORMWATER REFUNDING REVENUE BONDS ORDINANCE A public hearing will be held on the following-entitled Ordinance at a regular meeting of the City Council of The City of Huntington (the “City”) to be held on Tuesday, November 12, 2024, at 7:30 p.m. (or as soon thereafter as the matter may be heard) in Conference Rooms 4 and 5 at Marshall Health Network Arena, 1 Civic Center Plaza, Huntington, West Virginia, and at such hearing any person interested may appear before the City and present protests, and all protests and suggestions shall be heard by the City and it shall then take such actions as it shall deem proper in the premises upon an Ordinance entitled: AN ORDINANCE AUTHORIZING THE REFUNDING OF THE OUTSTANDING SEWER REVENUE BONDS, SERIES 2015 A (TAX-EXEMPT), THE OUTSTANDING SEWER REFUNDING REVENUE BONDS, SERIES 2022 A, AND THE OUTSTANDING STORMWATER REFUNDING BOND ANTICIPATION NOTE, SERIES 2023, OF THE CITY OF HUNTINGTON, WEST VIRGINIA (THE “CITY”) THROUGH THE ISSUANCE BY THE CITY OF NOT MORE THAN $16,000,000 IN AGGREGATE PRINCIPAL AMOUNT OF COMBINED SEWER AND STORMWATER SYSTEM REFUNDING REVENUE BONDS, SERIES 2024 A (TAX EXEMPT); PROVIDING FOR THE RIGHTS AND REMEDIES OF, AND THE SECURITY FOR, THE REGISTERED OWNERS OF SUCH BONDS; AUTHORIZING THE PREPARATION AND DISTRIBUTION OF A PRELIMINARY OFFICIAL STATEMENT; AUTHORIZING THE EXECUTION AND DELIVERY OF A BOND PURCHASE AGREEMENT, AN OFFICIAL STATEMENT, A CONTINUING DISCLOSURE AGREEMENT AND OTHER DOCUMENTS RELATING TO THE BONDS; AND ENACTING OTHER PROVISIONS WITH RESPECT TO SUCH BONDS. The above quoted title of the Ordinance describes generally the contents thereof and the purposes of the Combined Sewer and Stormwater Refunding Revenue Bonds contemplated thereby. The City contemplates the issuance of the Combined Sewer and Stormwater Refunding Revenue Bonds described in the Ordinance. The proceeds of the Combined Sewer and Stormwater Refunding Revenue Bonds will be used to (i) refinance the City’s Sewer Revenue Bonds, Series 2015 A (Tax-Exempt), Sewer Refunding Revenue Bonds, Series 2022 A and Stormwater Refunding Bond Anticipation Note, Series 2023 (the “Project”); and (ii) pay certain costs of issuance of the Combined Sewer and Stormwater Refunding Revenue Bonds. The Combined Sewer and Stormwater Refunding Revenue Bonds are payable solely from revenues to be derived from the ownership and operation of the sewerage and stormwater system of the City. No taxes may at any time be levied by the City for the payment of the Combined Sewer and Stormwater Refunding Revenue Bonds or the interest thereon. The above-entitled Ordinance was approved and adopted on second reading by the City Council on October 28, 2024. A certified copy of the above-entitled Ordinance is on file with the City Clerk of the City for review by interested parties during regular office hours.
