PARCEL TWO Located near the Village of Halltown, containing 7.43 acres, more or less, and shown and described as “Raleigh Moore 7.43 Acs.” on a plat of survey entitled “Plat, Division of Lands of Raleigh Moore, Halltown, Harpers Ferry District, Jefferson County, West Virginia”, dated April 17, 1952, prepared by J. Skinner, S.J.C., and recorded in the aforesaid Clerk’s office in Deed Book 188, page 36, to which reference is hereby made for a more complete and accurate description thereof; LESS AND EXCEPTING THEREFROM, HOWEVER:  (1) that certain parcel of real estate containing 0.65 acre, more or less, vested in the State Road Commission of West Virginia, a corporation, by virtue of an Order dated July 23, 1968, entered by the Circuit Court of Jefferson County, West Virginia, in the matter of “The State Road Commission of West Virginia, a corporation, et al., vs. Raleigh N. PARCEL THREE Located near the Village of Halltown, containing about 

three-fourths (3/4) of an acre, more or less, and being a portion of the seven and one-half (7.5) acre tract conveyed by Lloyd L. Watson, et ux., to 

Marshall E. Kerns, et ux., by a Deed dated July 10, 1963, and recorded in the aforesaid Clerk’s office in Deed Book 261, page 161, being the entirety of said tract that adjoins and lies north of U.S. Rt. 340, and also being the residue of said tract that lies north of U.S. Rt. 340 right-of-way upon entry of an Order of the Circuit Court of Jefferson County, West Virginia, dated July 23, 1968, in the matter of “The State Road Commission of West Virginia, et al., vs. Marshall E. Kerns, et ux., et al.”, Civil Action No. 1138, a certified copy of which is recorded in the aforesaid Clerk’s office in Deed Book 297, page 538.  Reference is hereby made to a plat of survey entitled “Miss Virginia Lucas to James E. Brown”, dated December 5, 1918, prepared by James K. Hendricks, S.J.C., which is attached to, made a part of, and incorporated in a Deed from Frank Beckwith, Special Commissioner, to 

J. E. Brown, dated March 25, 1911, and recorded in the aforesaid Clerk’s office in Deed Book 105, page 442; and to that certain map entitled “The State Road Commission of West Virginia, Right of Way Plans of State Road Project No. F. 64-(4), Route No. U.S. 340, Charles Town and Harpers Ferry Districts, Jefferson County, Charles Town to Secondary Route 27”, a copy of which map is lodged in the aforesaid Clerk’s office.

AND BEING the same parcel of real estate which was conveyed from Marshall Eugene Kerns, widower, to Myrna C. Bowers by a Deed dated June 28, 2005, and recorded in the aforesaid Clerk’s office in Deed Book 1011, page 1.

AND BEING ALSO all and the same parcels of real estate of which the said Myrna C. Bowers died seized and possessed (except as to the sale and conveyance described above by Deed recorded in Deed Book 1324, page 620).  The said Myrna C. Bowers died, testate, a resident of Jefferson County, West Virginia, on August 15, 2006, and pursuant to the terms of her Last Will And Testament, duly probated and recorded in the aforesaid Clerk’s office in Will Book 14, page 251, she devised the rest, residue and remainder of her estate to her son, Bruce D. Bowers.  The said Bruce D. Bowers died, testate, a resident of Jefferson County, West Virginia, on October 15, 2017, and pursuant to the terms of his Last Will And Testament, duly probated and recorded in the aforesaid Clerk’s office in Will Book 28, page 589, he devised the rest, residue and remainder of his estate to the Trustee of The Myrna C. Bowers Family Revocable Trust under Agreement dated April 29, 2008.

AND BEING ALSO the residual portions of those three (3) certain parcels of real estate which were conveyed by Wayne C. Welty, Successor Trustee of The Myrna C. Bowers Family Revocable Trust (under Agreement dated April 29, 2008), to Walter William Bowers, et al., by a Deed dated the 15th day of June, 2023, and recorded in the aforesaid Clerk’s office in Deed Book 1302, page 609, and being described therein as Parcel One, Parcel Two, and Parcel Three (Parcel Four therein described having been sold, with a portion of Parcel 2, on June 13, 2024, by the aforesaid Deed recorded in the aforesaid Clerk’s office in Deed Book 1324, page 620).

THE SALE AND CONVEYANCE OF THIS REAL ESTATE WILL BE MADE SUBJECT TO all easements, rightsofway, restrictive covenants, conditions, reservations and other conditions of record found and enumerated in the chain of title and those reasonably apparent upon an inspection and view of said real estate or as determined by a survey.

THIS SALE SHALL ALSO BE MADE SUBJECT TO the rights of any person or persons occupying the premises, if any there be, and the Special Commissioner shall not be under any duty to cause any person or persons who may be occupying said premises to vacate the same.  The property will be sold in an “AS IS” condition and the Special Commissioner makes no warranty of any type as to the condition of any improvements located upon the premises, if any there be.

The Special Commissioner’s deed to any purchaser will not contain any warranty of title.

1.Parcel One which will be auctioned first.

2.Parcel Two will be next auctioned, with the high bid being held.

3.Parcel Three will be next auctioned, with the high bid being held.

4.Parcel Two and Parcel Three will be auctioned as combined.

5.The bid(s) obtained by paragraphs 2, 3 and 4 (above) which results in the greatest amount will be accepted by the Special Commissioner. 

TERMS OF SALE

Cash or bank check on day of sale equal to ten percent (10%) of the highest bid, and the balance due, in cash, forty-five (45) days from the date of confirmation of said sale by the Circuit Court of Jefferson County, West Virginia, to which this sale shall be subject.  All real estate taxes and all other charges and assessments levied against the property shall be pro-rated to the date of settlement.  All recording fees and charges and all transfer and excise taxes shall be paid by the purchaser.

PART 1 ADMINISTRATIVE CODE, CHAPTER 5 ADMINISTRATIVE, ARTICLE 148 SCHEDULE OF APPEAL FEES AND OTHER CHARGES, SECTION 148.06 PLANNING AND ZONING SERVICES

The City of Charles Town will hold a public hearing on Monday, January 6, 2025, at 7:00 pm, prevailing time, to consider an amendment to the Codified Ordinance with Regard to Part 1 Administrative Code, Chapter 5 Administrative, Article 148 Schedule of Appeal Fees and Other Charges, Section 148.06 Planning and Zoning Services.  The proposed ordinance, which was introduced to City Council by first reading on December 2, 2024, may be inspected by the public at the Office of the City Clerk by visiting City Hall at 101 E. Washington Street, Charles Town, WV or by emailing the City Clerk at [email protected] and requesting an electronic copy.
