TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in her by that Deed of Trust, dated March 16, 2019, and duly recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Deed Book No. 753 at Page 441, and Deborah Hobbs did convey unto James W. Keenan, Trustee certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Elizabeth K. Campbell, as the Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Trustee having been instructed by Deborah Hobbs to foreclose there under, will offer for sale at public auction at the front of the Fayette County Courthouse in Fayetteville, West Virginia, on Friday, January 10, 2025, at the hour of 9:00 am, the following described real estate, together with its improvements, easements and appurtenances thereunto belonging situate in City of Oak Hill, Plateau District, Fayette County, West Virginia, and being more particularly bounded and described as follows:
Tract No. 1- The surface of all that certain lot or parcel of land lying in or near the City of Oak Hill, Fayette County, West Virginia, known as Lot No. 2, Section 16, and Part of Lot No. 3 Section 16 of LILLY COURT ADDITION to said City as shown by a map thereof recorded in the County Clerk’s office of Fayette County, West Virginia, in Map Book 3, at Page 24, to which reference is hereby made, Said Lot borders 126.6 feet of Rogers St. and extends back therefrom with an alley a distance of 40.65 feet to Lot No. 3; and back on opposite side with another alley a distance of 40 feet to said Lot No. 3, bordering thereon 13378 feet. Said Lot 3 borders 40 feet on an alley, as shown on said map, and extends back therefrom with Lot No. 2 a distance of 133.78 feet to another alley, and back on opposite side with Lot 4 a distance of 141 feet said second mentioned alley, bordering thereon 40.65 feet. – There is expressly reserved and excepted from this conveyance 8.77 feet off the south-east side of Lot No. 3, conveyed by Deed of July 26, 1939 to Elizabeth Bunch.
Tract No. 2 – Beginning at a stake on am alley, (now Central Ave. extended), 8.77 feet west of line between Lot No. 3 and Lot No. 4, and running parallel with said line 139.42 feet to an alley and with same in an eastern direction, 30.48 feet, passing said line between Lot No. 3, and No. 4 –2t.57 feet to a new line through Lot No. 4 of 21.23 feet wide, together with the portion of Lot No. 3 on south-east side, of 8.77 feet wide, making a total of 30 feet on front and 30.48 feet on back.
This Deed of Trust is made and accepted subject to all continuing reservations, restrictions, conditions, covenants, easements and rights-of way made and contained in all prior deeds in the chain of title to the property herein conveyed. At the time of the execution of the Deed of Trust, this property was reported to have an address of 914 Central Avenue, Oak Hill, West Virginia. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers of the sale shall be responsible for paying the recording costs and also tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $89,000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale. FEDERAL TAX LIEN: in the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale.
