TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated January 16, 2008, and duly recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Book No. 3535, at Page 274, Larry K Smith did convey unto Philip Hereford, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Nationstar Mortgage LLC to foreclose thereunder, will offer for sale at public auction at the front door of the Kanawha County Courthouse in Charleston, West Virginia, on January 28, 2025 at 10:00 AM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 25 – Union District, Kanawha County, West Virginia, and more particularly described as follows: All of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, being situate in Union Tax District, Kanawha County, West Virginia, and being a part of Valley View Addition, and being more particularly bounded and described as follows: BEGINNING at an iron pin in the westerly right of way line of U. S. Route No. 35; said beginning point being located N. 31 57′ W. 167.00 feet from a concrete highway monument in said westerly right of way line marking the point of tangent, said beginning corner being located at the most northerly corner to a parcel of land heretofore conveyed to Edward and Reba Bowen; and running thence with the line of said Bowen tract S. 58 01′ W. 202.76 feet to an iron pin located at the most westerly corner to the said Bowen tract; thence running with the outside boundary line of the Goodwin 92 acre tract N. 23 59′ W. 201.94 feet to an iron pin located at the most southerly corner to a parcel of land heretofore conveyed to R. S. Spilman, Jr. and E. D. Spilman; thence running with one line of said Spilman tract N. 58 03′ E. 174.77 feet to an iron pin in the westerly right of way line of U. S. Route No. 35 and located at the most easterly corner to said Spilman tract; thence running with the said right of way line S. 31 57′ E. 200.00 feet to the place of beginning, and being part of the J. P. Goodwin 92.55 acre tract lying west of U. S. Route No. 35 in Union Tax District, Kanawha County, West Virginia. And being the same property conveyed unto Karen E. Smith and Larry K. Smith, her husband, as joint tenants with the right of survivorship and not as tenants in common, by Dolores R. Reed and William Reed, her husband, et als., by deed dated June 21, 1993, of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 2319, at page 453. The said Karen E. Smith died a resident of Kanawha County, West Virginia, on June 10, 2002, title to the property hereby conveyed having vest in her spouse, Larry K. Smith by virtue of the survivorship clause in said deed. There is excepted and reserved from this conveyance all that certain lot, tract or parcel of land, previously conveyed by Robert Lett and Geneva Lett, his wife, unto Myrna L. Rader and William E. Rader, her husband, by deed dated February 17, 1965, and duly of record in the aforementioned Clerk’s Office in Deed Book 1428, at page 621, reference to said deed is hereby made for further information of the same. This conveyance is made subject to any and all covenants, restrictions, and easements as the same may appear in instruments of record in the aforesaid Clerk’s Office. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 4901 Washington St W, Charleston, WV 25313. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $8000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
