TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated May 9, 2017, and duly recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed of Trust Book 4240, at Page 126, Christopher Via did convey unto Mary E. Page, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Kanawha County Courthouse, in Charleston, West Virginia, on February 13, 2025, at 8:40 AM The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Union District, Kanawha County, West Virginia, and more particularly described as follows: All of that certain lot, tract or parcel of land situate in Union District, Kanawha County, West Virginia, being the southerly part of Lot B of the subdivision of Lots Nos. 5 and 6, Block B, Flatwoods Farms, near Cross Lanes, and being more particularly bounded and described as follows: BEGINNING at an iron pin, which said iron pin is the southeastern corner of Lot B thence with the common line between Lot B and Lot C N. 1 50′ E. 100.00 feet to a stake; thence leaving said common line between Lots B and C N. 88 10′ W. 75.00 feet to a stake in the common time between Lots A and B; thence with said common line S. 1 50′ W. 100.00 feet to an iron pin in the common line between Lot B and Lot 4; thence with the said common line S. 88 10′ E. 75.00 feet, more or less, to an iron pin, the point of beginning, and being the same property shown on a map entitled, “Survey of Southerly Part of Lot “B” of the Subdivision of Lots #5 and #6, Block “B” of Flatwoods Farms, near Cross Lanes, Union District, Kanawha County to be conveyed to William & Rebecca Fox”, dated January 22, 1984, by C. Russell Rader, RPCE, at a scale of 1″= 20′, a copy of which is of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 2055, at page 738, which reference is made for a more particular description of the subject parcel. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 5247 Silverado Lane, Cross Lanes, WV 25313. AND BEING the same real estate which was conveyed to Christopher Via, by Deed dated May 4, 2017, from Nathan L. Garnes, and recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 2971, at Page 662. The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
