NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated April 29, 2010, executed by Borrower, Ashley R Toler, to Bowles, Rice, McDavid, Graff & Love, the Trustee of record in the office of the Clerk of the County Commission of Cabell County, West Virginia, in Book 2329, at Page 328. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 4815 Spring Rd, Huntington, WV 25705. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated January 27, 2025. The borrower defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Cabell County, in Huntington, West Virginia, on the following date: 27th day of March, 2025 at 11:00 a.m. PARCEL NO. I: All that certain tract, piece or parcel of land situate on the East Fork of Russell Creek, Guyandotte District, Cabell County, West Virginia, bounded and described as follows; Beginning at a point in the southern right of way line of Spring Road, said point being S. 90 0` E. 100.00 feet from the northwesterly corner of what was originally a 3.63 acre tract owned by Bowman F. Johnson, and being the northeasterly corner of the Isaiah Bird property; thence, leaving said right of way line and with the Bird line S. 10 30` E. 200.00 feet to a point; thence, continuing with said Bird line N. 90 0` W. 27.81 feet to a point; thence leaving the before mentioned Bird line N. 9 42` W. 199.14 Feet to the southerly right of way line of said road; thence with said right of way line S. 90 0` E. 25.00 feet to the point of beginning, containing 0.12 acre, more or less. II: All that certain tract, piece or parcel of land situate on the East Fork of Russell Creek, Guyandotte District, Cabell County, West Virginia, and described as follows: Beginning at a point in the easterly line of Yvonne Ann Poteet, said point being S. 80 18` W. 115.00 feet from a point which is S. 9 42` E. 50.00 feet from as iron pipe which is the northeasterly corner of what was originally a 3.63 acre tract, the remainder of which is owned by Bowman F. Johnson; thence, from the beginning, leaving the Poteet line S. 9 42` E. 56.97 feet to a point; thence, S. 80 18` W. 73.49 feet to a point in the easterly line of Isaiah G. Bird; thence, with said line N. 10 39` W. 195.31 feet to a point in the southerly right of way line of Spring Road; thence, with said right of way line S. 85 04` E. 78.78 feet to the northwesterly corner of Yvonne Ann Poteet; thence, with said line S, 9 42` E. 118.43 feet to the point of beginning, containing 0.32 acre, more or less. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
