Snyder, Frontier West Virginia Inc., Gulf Oil Corporation, NPAR, LLC, Unknown Persons/Owners, and William Helms, Jr., Sheriff of Marshall County, West Virginia (hereinafter sometimes referred to as “the aforementioned respondents”), that a Petition for Condemnation/Right of Entry has been filed in the Circuit Court of Marshall County, West Virginia, and is known as Civil Action No. CC-25-2025-C-6, and styled AEP West Virginia Transmission Company, Inc. v. Michael J. Snyder, et al. Said Petition for Condemnation/Right of Entry under the West Virginia laws of eminent domain seeks property for the construction of electrical transmission, distribution, and communication lines and appurtenant equipment and fixtures, and condemnation and right of entry on behalf of AEP West Virginia Transmission Company, Inc. situate in Meade District, Marshall County, West Virginia, identified as Tax Map 5, Parcel 5.4, and recorded in the office of the Clerk of the County Commission of Marshall County, West Virginia, in Deed Book 655, at page 447, and further identified as Tax Map 5, Parcel 5, and recorded in the office of the Clerk of the County Commission of Marshall County, West Virginia, in Deed Book 609, at page 638, and being more specifically bounded and described as follows: 64 A BOWMAN & O&G LESS COAL Situate in Meade District, Marshall County, West Virginia, and more particularly bounded and described as follows: Beginning at a corner fence post (formerly a stone) located at the southwest corner of the 126 acre tract of land that was conveyed from Harry J. and Alice V. Swaggart to George W. and Carol June McCain, by deed dated September 20, 1073, and of record in the Office of the Clerk of the Marshall County, West Virginia, in Deed Book No. 440, at page 344, from which the parcel to be described herein is to be conveyed out. Thence, from the said place of beginning and now with the southernmost line of the said 126 acre McCain tract, N. 83 40′ 34″ E. for a distance of 717.28 feet to a point at the southwest corner of a 5.807 acre tract of land that was conveyed to Donald E. and Marjorie V. Leach by deed dated March 8, 1957, and of record in the said Clerk’s Office in Deed Book No. 320, at page 274. Thence with the said lands of the 5.807 acre Leach tract for the following eight (8) courses: N. 06 54′ 41″ W. for a distance of 37.10 feet to a point; N. 67 01′ 19″ E. for a distance of 162.30 feet to a point; N. 45 53′ 19″ E. for a distance of 292.10 feet to a point; N. 83 48′ 19″ E. for a distance of 76.20 feet to a point; S. 89 09′ 41″ E. for a distance of 166.70 feet to a point; N. 37 21′ 19″ E. for a distance of 101.40 feet to a point; N. 14 30′ 19″ E. for a distance of 215.60 feet to a point; N. 10 43′ 19″ E. for a distance of 163.50 feet to a point at a common corner with a 6.924 acre tract of land also conveyed to Donald E. and Marjorie V. Leach by deed dated October 25, 1965, and of record in Deed Book No. 380, at Page 228. Thence, with the lands of the 6.924 acre tract for the following three (3) courses: N. 26 30′ 41″ W. for a distance of 178.50 feet to a rebar set; N. 47 31′ 19″ E. for a distance of 593.00 feet to a post; N. 87 19′ 30″ E. for a distance of 146.04 feet to a post; thence, leaving the lands of Leach, now with the lands of the grantor and existing fence line, N. 06 32′ 19″ W. for a distance of 416.21 feet to a one inch pipe found at the southeast corner of a 1.00 acre parcel of land that was conveyed to Ralph E. and Ruth K. Wellman by Deed Book No. 459, at page 419. Thence, with the lands of the said Wellman for the following six (6) courses: S. 82 53′ W. for a distance of 133.00 feet to a chiseled “+” found; N. 82 51′ 40″ E. for a distance of 163.98 feet to a one inch pipe found; N. 06 55′ 23″ W. for a distance of 133.00 feet to a one inch pipe found; S. 82 54′ 38″ W. for a distance of 163.74 feet to a one inch pipe found; N. 05 14′ 09″ W. for a distance of 133.00 feet to a one inch pipe found at the northwest corner of the 1.00 acre parcel of land conveyed to the said Wellman in Deed Book No. 459, at page 221. Thence, S. 82 53′ 12″ W. for a distance of 15.80 feet to a one inch pin found at the southernmost comer of a 1.98 acre parcel of land conveyed to David L. and Linda B. McMillan by deed dated December 2, 1987, and of record in Deed Book No. 536, at page 352. Thence, with the line of the 1.98 acre parcel, N. 02 20′ 12″ E. passing on line an iron pin in concrete found at 349.03 feet, for a total distance of 364.03 feet to a point in the center line of the traveled part of Bowman Ridge Road. Thence with the said road for the following six (6) courses: N. 85 57′ 42″ W. for a distance of 165.52 feet to a point; N. 80 21′ 37″ W. for a distance of 116.02 feet to a point; N. 53 54′ 20″ W. for a distance of 95.28 feet to a point; N. 46 28′ 42″ W. for a distance of 103.51 feet to a point; N. 53 17′ 13″ W. for a distance of 90.15 feet to a point; N. 68 40′ 50″ W. for a distance of 120.33 feet to a point in the center of the said road. Thence, leaving the road and now with the lands of a 0.98 acre parcel of land that was conveyed to Harley L. and Jeanette South by deed dated May 19,1959, and of record in Deed Book No. 339, at page 149, for the following two (2) courses: S. 02 46′ 37″ W. for a distance of 212.50 feet to a 5/8 inch rebar found, S. 74 59′ 37″ W. for a distance of 165 feet to a 5/8 inch rebar found. Thence, leaving the said 0.98 acre parcel and now through the lands of the grantor, S. 06 12′ 43″ W. for a distance of 198.76 feet to a point in a small creek. Thence, with the said creek, S. 07 28′ 30″ E. for a distance of 998.87 feet to a point at the intersection of said creek with a larger creek. Thence, with the said creek for the following four (4) courses: S. 52 10′ 15″ W. for a distance of 237.91 feet to a point; S. 81 23′ 00″ W. for a distance of 195.09 feet to a point; S. 69 14′ 10″ W. for a distance of 539.70 feet to a point; S. 84 03′ 17″ W. for a distance of 159.35 feet to a point in the said creek at its intersection with the original deed line of the grantor herein. Thence, with the same and existing fence line, S. 11 00′ 00″ E. for a distance of 983.15 feet to the place of beginning, containing 64.00 acres, more or less, as surveyed in the field in January, 1998, by Bryan A. Payne, West Virginia Registered Land Surveyor No. 977. Map 5, Parcel 5.4 District of Meade, Marshall County Deed Book 655, Page 447 35.02 A BOWMAN & O&G A certain tract of land situate upon the southern margin of Bowman’s Ridge Road (Marshall County Route No. 21) in the Meade District of Marshall County, West Virginia, bounded and being more particularly described as follows: Beginning for the same at a one inch pipe found in the original westernmost line of the grantors. Said point being located at the southwest comer of a 0.873 acre parcel of land that was conveyed to Harold W. White, Jr. by a deed dated October 2, 1989 and of record in the office of the County Commission of Marshall County, West Virginia in Deed Book No. 548 at page 272. Thence, from the said place of beginning with the westernmost line of the lands of the grantors herein and with an existing fenceline, S. 11′ 00′ 00″ E. for a distance of 1560.22 feet to a point located in the center of a small creek. Thence, leaving the said westernmost line and now with the said creek for the following four (4) courses: N. 84 03′ 17″ E. for a distance of 159.35 feet to a point. Thence, N. 69 14′ 10″ E. for a distance of 539.70 feet to a point. Thence, N. 81 23′ 00″ E. for a distance of 195.09 feet to a point. Thence, N. 52 10′ 15″ E. for a distance of 237.91 feet to a point located in the center of the aforesaid creek at its intersection with a smaller creek. Thence, with the second creek, N. 07 28′ 30″ W. for a distance of 998.87 feet to a point. Thence, leaving the said creek, N. 06 12′ 14″ E. for a distance of 198.76 feet to a found rebar located at the southwest comer of a 0.98 acre parcel of land that was conveyed to Harley L. South and Jeanette South, his wife, by deed dated May 19, 1959 and recorded in the said clerk’s office in Deed Book No. 339 at page 149. Thence, with the westernmost line of the said 0.98 South tract, N. 15 00′ 22″ W. passing on line an iron pin found at 210.00 feet, for a total distance of225.00 feet to a point located in the center of the traveled part of Bowman’s Ridge Road. Thence, with the same, S. 54 14’41” W. fora distance of 62.31 feet to a point. Thence, S. 42 16’55” W. for a distance of 386.16 feet to a point located in the said road. Thence, S. 50 30′ 00″ W. for a distance of 83.20 feet to a point. Thence, N. 85 52′ 00″ W. for a distance of 97.04 feet to a point. Thence, N. 75 39′ 44″ W. for a distance of 128.14 feet to a point located on the southern edge of Bowman’s Ridge Road. Said point is also located at the northeast comer of a 1.87 acre tract of land that was conveyed to Michael Joseph Baum, by deed dated August 14, 1980 and of record in Deed Book No. 489 at page 487. Thence, leaving the said road and now with the lands of the said 1.87 Baum tract, for the following five (5) courses: S. 07 15′ 25″ W. passing on line an iron pin found at 6.73 feet, for a total distance of 196.77 feel to a found iron pipe. Thence, N. 74 42′ 23″ W. for a distance of 167.34 feet to a found iron pin. Thence, N. 51 44′ 11″ W. for a distance of 52.73 feet to an iron pin found. Thence, N. 35 55′ 28″ W, for a distance of 140.16 feet to a 5/8 inch found iron pin. Thence, N. 45 05′ 06″ W. for a distance of 102.03 feet to a found 5/8 inch iron pin located at the southwest comer of the said 1.87 acre tract, and also located at the southeast comer of the previously mentioned 0.873 acre White parcel. Thence, with the southern line of the said lands of White, N. 86 23′ 42″ W. for a distance of 197,66 feet to the place of beginning, containing 35.02 acres, more or less. Map 5, Parcel 5 District of Meade, Marshall County Deed Book 609, Page 638 The aforementioned respondents are hereby notified a copy of said Petition for Condemnation/Right of Entry may be obtained from the Marshall County Circuit Clerk’s office at 600 7th Street, Moundsville, West Virginia, 26041, for the purposes of appearing and defending. The Petition for Condemnation/Right of Entry may also be obtained from the attorneys for AEP West Virginia Transmission Company, Inc., Jeffrey A. Kimble, Post Office Box 128, 140 West Main Street, Suite 300, Clarksburg, West Virginia, 26302-0128, or Douglas C. McElwee, 700 Virginia Street East, Suite 400, Charleston, West Virginia, 25301. The aforementioned respondents are further notified that a hearing on the said Petition for Condemnation/Right of Entry will occur on March 10, 2025, at 11:00 a.m., in the Circuit Court of Marshall County, West Virginia, located at 600 7th Street, Moundsville, West Virginia, 26041, before the Honorable Charles Richard Wilson. You may appear for hearing as stated above, and are notified that any failure to appear may result in the waiver of any defenses or claims, if any, you may have.
