ORDER OF PUBLICATION CIRCUIT COURT OF KANAWHA COUNTY, WEST VIRGINIA ORDER OF PUBLICATION IN THE MATTER OF: Michelle Morris and Howard “Mike” Morris, Plaintiffs v. Donald R. Owens, Jr., Melissa A. Owens, and Cassidy Owens, Civil Action No. 24-C-1303. Based on the executed affidavit of Colton C. Parsons, Esq. and Plaintiffs’ Motion for Order of Publication and to Extend Time for Service” the Court is satisfied that Petitioners used due diligence to ascertain the whereabouts of Donald R. Owens, Jr., Melissa A. Owens, and Cassidy Owens. However, such due diligence was without effect. Thus, service by publication is hereby ORDERED. There is now pending in the Circuit Court of Kanawha County, West Virginia the civil action captioned Michelle Morris and Howard “Mike” Morris, Plaintiffs v. Donald R. Owens, Jr., Melissa A. Owens, and Cassidy Owens, Civil Action No. 24-C-1303. Pursuant to the Verified Complaint, Plaintiffs commenced this Civil Action due to the breach of a residential lease agreement involving certain real estate located at 5290 David Drive, Cross Lanes, WV 25313. Additionally, Plaintiffs have asserted claims of unjust enrichment, fraudulent inducement, and property damage, relating to Defendants’ tenancy at the same address. Accordingly, it is hereby ORDERED that the Defendants, Donald R. Owens, Jr., Melissa A. Owens, and Cassidy Owens must appear and serve upon the Plaintiffs’ Counsel, Colton C. Parsons and S. Caleb Davis of the law firm Steptoe & Johnson PLLC, whose address is 707 Virginia Street, 17th Floor, Charleston, WV 25301 an Answer or other response to the Verified Complaint within thirty (30) days after the date of the first publication of this notice; otherwise, judgment by default may be rendered against them at any time thereafter. A copy of the Verified Complaint may be obtained from the Kanawha County Circuit Clerk’s Office, located in the Kanawha County Judicial Building, 111 Court Street, Charleston, WV 25301.
