NOTICE OF TRUSTEE SALE OF VALUABLE REAL ESTATE NOTICE IS HEREBY GIVEN that Ann R. Starcher (“Trustee”), by virtue of the authority vested in her as Trustee under that certain Deed of Trust dated May 17, 2021, and recorded in the office of the Clerk of the County Commission of Kanawha County, West Virginia, in Trust Deed Book 4508, at page 863, from Union Building, LLC, a West Virginia limited liability company, as Grantor and Borrower, to Ann R. Starcher and James M. Becker, as Trustee, for the benefit of Mace Industries, LLC, a New York limited liability company, as Beneficiary and Lender, has been directed by Mace Industries, LLC, to offer for sale at a public auction the following described real property on the front steps (Virginia St.) of the Courthouse of the County of Kanawha, in Charleston, West Virginia, on: March 27, 2025, at 10:00 a.m. the following described lot, tract, or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging: All of those certain lots, or parcels of land situate in the City of Charleston, Kanawha County, West Virginia, and more particularly bounded and described as follows: PARCEL NO. 1 All that certain lot or parcel of real estate together with the improvements thereon and the appurtenances thereunto belonging, situate in the City of Charleston, Kanawha County, West Virginia, in Charleston East Tax District, on the northwesterly side of Capitol Street and the southwesterly side of Kanawha Boulevard, East (formerly known as Kanawha Street), in said city, together with the 13-story office building known as the “Union Building” situate thereon, and more particularly bounded and described as follows: BEGINNING at the corner formed by the intersection of the northwesterly side of Capitol and the Southwesterly side of Kanawha Streets; thence along the northwesterly line of capitol Street, S. 47 W. 129 feet to a point in the edge of Kanawha River; thence down said River with an approximate course of N. 43 W. about 41′ 4″ to a point in the edge of said River; thence N. 47 E. 129 feet to a point on the southwesterly side of Kanawha Street, and with the same S. 43 E. 41 feet 4 inches to a place of BEGINNING. PARCEL NO. 2 South or Upriver Parcel: BEGINNING at the northeast corner of the Union Building at the juncture of the northwestern right of way line of Capitol Street (as originally laid out a thirty-three (33) feet in width) extended with the southwestern right-of-way line of Kanawha Boulevard, East, which beginning point is also located by two courses and distances, N. 40 36′ W. 33.71 feet and S. 47 W. 46.62 feet from the juncture of the southeastern right of way line of Capitol Street, as originally laid out, with the northeastern right of way line of Kanawha Boulevard, East, which is also the southwestern corner of a parcel known as the Terminal Building, now owned by Dennis D. Meadows and Daniel L. Meadows; thence with the common division line between the herein described and conveyed parcel and the Union Building parcel, now owned by Capitol Plaza, Inc., S. 74 W. 129 feet, more or less, to a point at low water mark of Kanawha River, common rear corner between the herein described and conveyed parcel and Capitol Plaza, Inc., parcel; thence running up the Kanawha River, S. 43 E. 10 feet to a point at low water mark; thence in a line parallel with the common division line between the herein described and conveyed parcel and said Capitol Plaza, Inc. parcel, N. 47 E. 130 feet, more or less, to a point in the right-of-way of Kanawha Boulevard, East, thence running through said right of way of Kanawha, East, N. 43 W. 10 feet to a point; thence continuing through said right of way of Kanawha Boulevard, East, S. 47 W. 1 foot to the point of beginning, and containing 1,300 square feet, more or less. PARCEL NO. 3 North or Downriver Parcel: BEGINNING at a point, the northwest corner of the Union Building (which beginning point is located from the juncture of the southeastern right of way line of Capitol Street, as originally laid out, with the northeastern right of way line of Kanawha Boulevard, East, which is also the southwestern corner of a parcel known as the Terminal Building, now owned by Dennis D. Meadows and Daniel L. Meadows, by two courses and distances, N. 40 36 feet W. 33.71 feet and S. 47 W. 46.62 feet to a point, which point is the northeast corner of the Union Building at the juncture of the northwestern right of way line of Capitol Street (as originally laid out as thirty-three (33) feet in width) extended with the southwestern right of way line of Kanawha Boulevard, East, and thence from said last point, N. 43 W. 41.33 feet; thence from said beginning point with the common division line between the herein described and conveyed parcel and the Union Building parcel, now owned by Capitol Plaza, Inc., S. 47 W. 129 feet, more or less, to a point at low water mark of Kanawha River, common rear corner between the herein described and conveyed parcel and Capitol Plaza, Inc. parcel; thence running down the Kanawha River, N. 43 W. 10 feet to a point; then in a line parallel with the aforesaid common division line between the herein described and conveyed parcel and said Capitol Plaza, Inc. parcel, N. 47 E. 130 feet, more or less, to a point in the right of way of Kanawha Boulevard, East, S. 43 E. 10 feet to a point; thence continuing through said right of way of Kanawha Boulevard, East, S. 47 W. 1 foot to a point of beginning, and containing 1,300 square feet, more or less. Meadows; thence with the common division line between the herein described and conveyed parcel and Capitol Plaza, Inc. parcel, N. 43 W. 41.33 feet to a point at the northwest corner of the Union Building; thence running into the right of way of Kanawha Boulevard, East, N. 47 E. 1 foot to a point; thence in a line herein described and conveyed parcel and Capitol Plaza, Inc.’s parcel, S. 43 E. 41.33 feet to a point; thence running through said right of way of Kanawha Boulevard, East, S. 47 W. 1 foot to the point of beginning, and containing 41.33 feet, more or less. AND BEING the same real property conveyed by a deed from The Riggs Corporation, a West Virginia corporation, to Union Building, LLC, a West Virginia limited liability company, by a deed dated May 17, 2021, and recorded in the office of the Clerk of the County Commission of Kanawha County in Deed Book 3098, at page 606. TERMS OF SALE 1. Cash in hand paid on day of sale by wired funds or certified check; provided, however, Trustee may accept proof of funds or other evidence of funds and accept receipt thereof within five (5) days of the sale or as otherwise determined by Trustee. Failure by the highest bidder to provide funds as directed by Trustee will result in their bid being forfeited and the next highest bidder being declared the winner. 2. The purchaser shall pay the excise transfer tax imposed by W.Va. Code 11-22-2, recording fees, and real property taxes connected and associated with the real property. 3. Trustee reserves the right to adjourn the sale, for any reason or for no reason, for a time or from time to time without further notice by announcement at the time and place of the sale described above. Trustee may reject any or all bids. 4. The real property will be sold in “as is” condition. Trustee will have no duty to cause any tenant or person occupying the real property to vacate. 5. The real property will be conveyed subject to all covenants, restrictions, easements, rights of way, reservations which may be a matter of record in the aforesaid Clerk’s office or that may be revealed by visual inspection or an accurate survey of such real property, and all prior liens and encumbrances, including, without limitation, liens for real estate taxes. 6. Trustee will deliver a Trustee’s deed to the purchaser without any covenant or warranty (express or implied). 7. Trustee makes no representations and warranties about the title of the real estate to be conveyed. 8. If there is one or more valid and enforceable federal tax liens against the real property, the United States will have the right to redeem the real property within a period of 120 days from the date of the sale or the period allowed for redemption under state law, whichever is longer.
