The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated June 29, 2021, and duly recorded in the Office of the Clerk of the County  Commission of Jefferson County, West Virginia, in Document No. 202100011775, in Book No. 2392, at Page 345, Storme A Frame did convey unto Seneca Trustees Inc., Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Bank of America, N.A. to foreclose thereunder, will offer for sale at public auction at the front door of the Jefferson County Courthouse in Charles Town, West Virginia, on

All the following described real estate, situate on the east side of the Opequon Creek in Middleway District, Jefferson County, West Virginia, more particularly designated and described on a palt of “Hidden River Farm, Section 6”, made by Richard U. Good, C.L.S., dated June 2, 1972, and recorded in the Office of the Clerk of the County Court of Jefferson County, West Virginia, in Plat Book No. 3, Page 13, as Lot No. 16, containing 2.495 acres; together with a non-exclusive right of way over all roadways, delineated on said plat or situated on any other portion of said subdivision, whether now platted or not, for access to and from said land.

And being the same real estate conveyed to the Louise Collins Garrett, Trustee under that certain trust agreement entitled Louise Collins Garrett Revocable Trust, dated April 27, 1995, by deed April 27, 1995, from Louise Collins Garrett, Trust under that certain trust agreement dated March 16, 1989, and recorded in the Office of the Clerk of the County Commission of Jefferson County, West Virginia, in Deed Book 803, at page 630. And being the same property conveyed to Louise Collins Garrett dated March 16, 1989, in Deed Book 625, at page 556.  The said Louise Collins Garrett passed from her life on January 19, 2000, and by virtue of the Trust the aforesaid individuals were granted power of sale by the Trust and are sole beneficiaries of the Trust. The said Angela Marie Walitalo and also known as Angela M. Pereschuk, passed from her life on May 1, 2002, her death certificate attached hereto.

Subject to restrictions, reservations, easements, covenants, oil, gas or mineral rights of record, if any.

Being previously conveyed by deed from the Louise Collins Garrett Revocable Trust, dated April 27, 1995, by Sharri Lynne Walitalo, as Trustee of the Trust and in her capacity as a life tenant under the Trust and individually, and Kevin Michael Walitalo, as a successor Trustee of the Trust, and in his capacity as a life tenant under the Trust, and in capacity of the beneficiary under the Trust, and in his capacity as the representative of the infant son of Kevin Michael Walitalo, and in his capacity as the representative of any unborn descendants of Kevin Michael Walitalo to Storme A. Shiley, dated 02/01/2016, and recorded on 02/23/2016 at document reference 1168 / 316 in Jefferson County, West Virginia.

At the time of the execution of the Deed of Trust, this property was reported to have an address of: 55 Garrett Lane, Kearneysville, WV 25430.

The referenced real estate is being sold subject to that certain Deed of Trust dated February 19, 2016 and recorded on February 23, 2016 in Book No. 2079, at Page 381.

The referenced real estate will be conveyed, with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges.  The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed).  The purchasers shall be responsible for payment of all real estate taxes.

The subject property will be sold in “AS IS” condition.  The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS:  $5000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.

FEDERAL TAX LIEN:  In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale.  The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
