NOTICE OF REQUEST FOR LEGAL SERVICES PROPOSAL The Town of Rupert, located in Greenbrier County, West Virginia, is in the process of obtaining legal services for its Water Distribution System Improvements project. Professional services will be needed to provide: (1) Advice, counsel and approval of contracts; (2) Bid bonding approvals and other approvals by the funding agencies; (3) Preparation and submission of required information to the West Virginia Public Service Commission; and (4) Any other duties requested by the Town pertaining to this project. Procurement of said services shall be in accordance with OMB Circular A- 102, Attachment 0, Section 11, paragraph C(5). Contracts are to be awarded on a per/hour rate with a ceiling amount. All attorneys interested in being considered for this project must submit a proposal detailing qualifications, technical expertise, and related prior experience. The Town of Rupert may also need legal services for the preparation of easements, rights-of-way, deeds and title searches pertaining to the proposed project. The objective of the competitive process is to objectively select the attorney who will provide the highest quality of service at a realistic fee. Accordingly, technical qualifications and experience will be weighed heavily. It is the responsibility of the respondent to ensure receipt of the proposal by the date and time specified. Attention is directed to the fact that the proposed funding for the project may include HUD Community Development Block Grant (CDBG), DEP Clean Water State Revolving Fund (CWSRF), the West Virginia Infrastructure and Jobs Development Council (IJDC), USDA Rural Development (USDA – RUS), Drinking Water Treatment Revolving Fund (DWTRF), US Economic Development Administration (USEDA), US Army Corps of Engineers or other potential sources. All work will be performed in accordance with the regulations issued by any funding agency and the State of West Virginia appertaining hereto. The selected firm will be required to comply with all regulations including but not limited to Title VI of the Civil Rights Act of 1964, Executive Order 11246 and the provisions of Executive Order No. 10925 as included therein, Section 109 of the Housing and Urban Development Act of 1974, Conflict of Interest Statement of Access to Records provision. The proposed work to be performed may be subject to the requirements of Section 3 of the Housing and Urban Development Act of 1968, as amended, 12 U.S.C. 1701u (Section 3). The purpose of Section 3 is to ensure that employment and other economic opportunities generated by HUD assistance or HUD-assisted projects covered by Section 3, shall to the greatest extent feasible, be directed to low-and very low-income persons, particularly persons who are recipients of HUD assistance for housing. The project sponsor will afford full opportunity for disadvantaged business enterprises to submit a show if interest in response to this invitation and will not discriminate against any interested firm or individual on the grounds of race, creed, color, sex, age, handicap or national origin in the contract award. This contract will be awarded to the responsible offeror whose proposal is within the competitive range and determined to be the most advantageous to the project sponsor, price and other factors considered.
