NOTICE OF TRUSTEE SALE OF VALUABLE REAL ESTATE
Pursuant to the authority vested in the undersigned by deed of trust dated the 1st day of February, 1993, signed by Ostel E. Dobbins and Virginia Dobbins, husband and wife, to William F. Patton, acting State Director of the Farmers Home Administration for the State of West Virginia, Trustee(s), which said deed of trust is of record in the Office of the Clerk of the County Commission of Clay County, West Virginia, in Trust Deed Book 77, at page 58, and Golden & Amos, PLLC, Trustee having been requested so to do by the Secured Creditor, and default having been made under the terms and conditions of said deed of trust, and the provisions in said deed of trust concerning acceleration having been complied with by the Secured Creditor and present holder of the note, said Trustee will sell at public auction at 10:00 o’clock a.m. on the
11th day of FEBRUARY 2025
at the front doors of the Courthouse in Clay County, West Virginia, the following described real estate:
All of that certain lot, tract or parcel of land situate on the waters of Dismal Creek, in the District of Henry, County of Clay, and State of West Virginia, bounded and described as follows:
Beginning at a 1/2” iron rod set at 15” Pine and 18’ east of the center of Secondary 13/2, a corner to the Othel Burdette tract; thence with Secondary 13/2, N. 18-21 E. 111.6’ to the center of a water meter 16’ east of the center of Secondary 13/2; thence N. 36-19 E. 133-7’ to a 1/2” iron rod set at a 5” Persimmon and 20’ east of the center of Secondary 13/2 and with the McKown tract, S. 55-14 E. 531.3’ to an 8” Beach on the east bank of Dismal Creek and in a line of the Eddy Johnson tract, also a corner to the aforementioned Burdette tract; thence with the Burdette tract, N. 80-48 W. 558.0’ to the place of beginning, containing 1.52 acres, more or less, and as more fully shown upon that certain map or plat of survey made by William A. Roberts, L.L.S. #714, dated January 29, 1993.
Being the same property conveyed unto Ostel E. Dobbins and Fannie Virginia Dobbins, husband and wife, by Carlos Samples and Letha V. Samples, his wife, by deed dated the 6th day of March, 1973, and of record in the Office of the Clerk of the County Commission of Clay County, West Virginia, in Deed Book 108 at page 287.
Subject, however, to the operative rights to and for the minerals and mineral substances in and underlying said land as said rights are in others vested.
The Grantors herein covenant and represent that the property herein conveyed contains no underground storage tanks which are being actively used for storing any regulated substance, nor do they have actual knowledge, or reason to believe, that such real property or substrata contains an underground storage tank, or that said property was used for the storage treatment or disposal of hazardous waste, nor did they have actual knowledge that such property was used for such purposes at any time prior thereto.
Formerly described prior to survey as:
Situate on Dismal Creek, a tributary of Big Laurel Creek, in Union District, Clay County, West Virginia, and further bounded and described as follows:
Beginning at a set stone and sumac at East edges of the public road, corner to what is known as the Tommy Samples land but which is now owned by Chester Burdette, and running thence with said Samples-Burdette line in an easterly direction to a set stone and white walnut on the bank of said Dismal Creek; thence in a northwesterly direction to a persimmon tree at the East edge of said public road; and running thence with said road to the place of beginning, containing two acres, more or less.
It is the intention of this notice to sell the secured property by proper description as was intended to be transferred and conveyed in the aforesaid deed of trust.

TERMS OF SALE: Cash in hand on day of sale or within 30 days of date of sale upon terms to be agreed upon between Trustee and successful bidder, time being of the essence; payment for unpaid real estate taxes to be assumed by the purchaser. The Trustee does not warrant title or fitness to this property; it is being purchased as is; this is a buyer beware sale and any buyer is advised to retain counsel before the sale. If there is any part of the process of sale which is found to be objectionable, the Trustee reserves the right to cancel the sale. No purchaser should take possession or make improvements in the premises until the Trustee deed is delivered or recorded. A third-party purchaser at sale will be required to pay the purchase price plus all recording and transfer fees.
Trustee at sale is under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
The party(ies) secured by the Deed of Trust reserve the right to purchase the property at such sale. If the purchaser at sale is unable to complete the terms of purchase within 30 days, the Trustee reserves the right to transfer the property to the next highest bidder.
Any sale hereunder may be adjourned from time to time without any notice other than oral proclamation at the time and place appointed for this sale or by posting of a notice of same. Should the Trustee not appear at the time appointed for the sale and there is no notice posted of a continuance please contact the office of the Trustee to make further inquiry. Any sale may be conducted or adjourned by the designated agent or attorney of the Trustee. The undersigned is fully vested with the authority to sell said property as Trustee by instrument of record. Some Trustee sales may be conducted by a servicer required Auction Company. In that event, the auctioneer will be acting under an “Auction Services Agreement.”
