TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated November 3, 2015, and duly recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Book No. 4135, at Page 664, Gregory Starcher and Kara Starcher did convey unto Douglas McElwee, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Rocket Mortgage, LLC f/k/a Quicken Loans, LLC f/k/a Quicken Loans Inc. to foreclose thereunder, will offer for sale at public auction at the front door of the Kanawha County Courthouse in Charleston, West Virginia, on April 15, 2025 at 10:00 AM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 28 – Washington District, Kanawha County, West Virginia, and more particularly described as follows: All that certain lot or parcel situate in Washington District, Kanawha County, West Virginia, which said lot or parcel of land is more particularly bounded and described as follows: BEGINNING at an iron pin post, which said iron post is located N. 75 13′ W. 322 feet, more or less, from the westerly right of way line of Coal River Road in the common division line between property now owned by W. H. Templeton and property now or formerly owned by Willard Yoder; thence S. 0 06′ W. 82.7 feet to an iron pin; thence N. 83 45′ W. 246.87 feet to an iron post; thence N. 4 50′ W. 136.27 feet to an iron post; thence S. 75 13′ W. 273.33 feet to the place of beginning, containing 64/100 acres, as shown upon that certain map entitled “Map Showing a Lot, With Access Right of Way Washington District Kanawha County West Virginia Made For Jay Templeton” made by William T. Watts, Licensed Land Surveyor, dated August 14, 1976, said map being duly of record in the Office of the Clerk of the Kanawha County Commission in Deed Book 1809 at page 71. For the consideration aforesaid, the parties of the first part do further GRANT and CONVEY unto the party of the second part an easement or right of way for the purpose of ingress and egress to and from the property herein conveyed to Coal River Road (also known as West Virginia Secondary Route 3), said right of way being 16 feet in width and being more particularly bounded and described as follows: BEGINNING at an iron pin which said iron pin is located in the southeasterly corner of the 64/100 acre tract hereinbefore conveyed, thence S. 2 16′ E. 141.3 feet to an iron pin; thence S. 79 05′ E. 282.06 feet to an iron pin, which said iron pin is located in the westerly right of way line of said Coal River Road; thence with the said Coal River Road and the meanders thereof 16 feet to a point; thence leaving the said right of way line of Coal River Road, N. 79 05′ W. 298.06 feet to a point; thence N. 2 16′ E. 157.0 feet, more or less, to a point located in the common division line between property now owned by W. H. Templeton and the 64/100 acre tract hereinbefore conveyed; thence with said division line S. 83 45′ E. 16 feet to the place of beginning, as shown upon the aforementioned map made by William T. Watts, Licensed Land Surveyor, dated August 14, 1976. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 77 Forum Rd, Tornado, WV 25202. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $9000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
