ADVERTISEMENT FOR BIDS TOWN OF ADDISON STORM SEWER REPLACEMENT / EXTENSION PROJECT WEBSTER COUNTY, WEST VIRGINIA Sealed bids for the Town of Addison Storm Sewer Replacement/Extension Project will be received by the Town of Addison, 146 McGraw Avenue, Webster Springs, West Virginia 26288, until 2:00 PM L.P.T., on April 29, 2025 for furnishing labor and materials and performing all work set forth in the Advertisement for Bids, Information for Bidders, Bid and Bid Schedule (Bid Form including Unit Price Basis of Bid), General Conditions, Supplementary Conditions, Specification Special Conditions, Technical Specifications and Plans (Drawings) prepared by Potesta & Associates, Inc., and all addenda issued prior to receipt of Bids. Immediately following the scheduled closing time for the reception of bids, all proposals which have been submitted in accordance with the conditions of this project will be publicly opened and read aloud. The Work to be bid upon is generally described as follows: Approximately 90 linear feet of 12-inch HDPE storm sewer line. Approximately 2,060 linear feet of 15-inch HDPE, and 60 linear feet of 15-inch PVC SDR 35 storm sewer line. Approximately 4,100 linear feet of 18-inch HDPE storm sewer line and approximately 55 concrete catch basins. Approximately 2,060 linear feet of 24-inch HDPE storm sewer line and approximately 16 concrete catch basins. Approximately 860 linear feet of 30-inch HDPE storm sewer line and approximately 7 concrete catch basins. Restoration of curbs, sidewalks, and existing floodwall. Other storm sewer line components, including connection of the existing storm sewer line, relocating the existing sanitary sewer service line, rehabilitation of the existing storm sewer line, pavement replacement and riprap channel. Construction time limit for the contract is 440 consecutive calendar days to substantial completion for Base Bid work. Envelope No. 1 will contain the required bidder information as outlined in the Contract Documents. Envelope No. 2 will contain the Form of Proposal only and be separate from Envelope No. 1. Bids will be opened and read aloud at the Webster Springs Mayor’s office, 146 McGraw Avenue, Webster Springs, West Virginia 26288 beginning at 2:00 P.M. on April 29, 2025. Envelope No. 1 will be opened first and the Bid Bond, Power of Attorney, Certificate of Compliance and other pertinent and required documents will be checked to make sure that all documents are in order. If the documents are found to be in order, Envelope No. 2 containing the Form of Proposal will then be opened and publicly read aloud. If the documents from Envelope No. 1 are not in order, Envelope No. 2 containing the Form of Proposal will not be opened and the bid will be considered non-responsive and will be returned to the Bidder. The successful low bidder will be provided four (4) complete set of plans and specifications at no additional cost after the contract has been signed. Any additional plans or specifications that are requested will be provided at a cost of seventy-five dollars ($75.00) for each set of plans and seventy-five dollars ($75.00) for each set of specifications. Payment by either cash or check must be made upon delivery. A bidder may not withdraw his bid for a period of ninety (90) days after the date set for the opening of bids. Bids shall be accompanied by a certified check or bid bond payable to the Town of Addison in an amount not less than five percent (5%) of the base bid. A mandatory pre-bid conference will be held at 10:00 AM local time on April 11, 2025 at the Webster Springs Mayor’s office, 146 McGraw Avenue, Webster Springs, West Virginia 26288. Attendance at the pre-bid conference is mandatory. Bids received after the scheduled closing time for the reception of bids will be returned unopened to the Bidders. Town of Addison reserves the right to reject any and/or all bids. Bidders must comply with the President’s Executive Order Nos. 11246 and 11375, which prohibit discrimination in employment regarding race, creed, color, sex, or national origin. Bidders must comply with Title VI of the Civil Rights Act of 1964, the Anti-Kickback Act, Section 3 Segregated Facilities, Section 109 and the Contract Work Hours Standard Act. Bidders must certify that they do not and will not maintain or provide for their employees any facilities that are segregated on the basis of race, color, creed, or national origin. Federal law prohibits discrimination on the ground of race, color, national origin, religion, age, handicap and sex in this project. Minority firms are particularly encouraged to participate. Bidders must comply with the requirements for Affirmative Action and Minority Business Enterprises participation as described in the Federal Specifications insert to the Contract Documents. Bidders must comply with Disadvantaged Business Enterprise utilization or EPA Federal Regulation 40 CFR Part 33-Procument Under Assistance Agreements stated that loan recipients and Contractors must comply with six affirmative steps as outlined on 33.240 and any other requirements of the state. DBE REQUIREMENTS Each Bidder must fully comply with the requirements, terms, and conditions as set forth in the contract documents to achieve Disadvantaged Business Enterprise (DBE) participation during the performance of this contract. The Bidder commits itself to the program for DBE participation and all other requirements, terms, and conditions of the bid conditions by submitting a property signed bid. The Bidder agrees to make “good faith efforts” to subcontract a portion of the total value of the contract to Disadvantaged Businesses. This shall be done in compliance with six (6) good faith efforts as outlined in 40 CFR 31.36(e). Failure to demonstrate good faith efforts may lead to rejection of bids. For the purpose of this program, the term “subcontractor” includes all construction, modification, and service work contracted for by the Bidder in the execution of the work under this contract. The work to be performed under this contract is subject to the requirements of Section 3 of the Housing and Urban Development Act of 1968, as amended, 12 U.S.C. 170l u (Section 3). The purpose of Section 3 is to ensure that employment and other economic opportunities generated by HUD assistance or HUD assisted projects covered by Section 3, shall, to the greatest extent feasible, be directed to low- and very low-income persons, particularly persons who are recipients of HUD assistance for housing. The parties of this contract agree to comply with HUD’s regulations in 24 CFR Part 135, which implement Section 3. Bidders’ attention is directed to the Section 3 “Clause” set forth in the contract documents. “NONDISCRIMINATION IN EMPLOYMENT” “Bidders on this work will be required to comply with the President’s Executive Order No. 11246. The requirements for bidders and contractors under this order are explained in the specifications.” Bidders are required to have West Virginia Contractor’s license per Section 21-11-11 of the West Virginia code. BUILD AMERICA BUY AMERICA REQUIREMENT P.L. 117-58 Infrastructure Investment and Jobs (IIJA) Act, 2021 (Act), includes a “Build America, Buy America (BABA)” requirement in Sections 70911 through 70917 that requires recipients to use iron, steel, manufactured products, and construction materials that are produced in the United States for projects for the construction, alteration, maintenance, or repair of public water system or treatment works. CONTRACTOR’S SALES TAX EXEMPTION “The Town is exempt from West Virginia Sales Taxes and. By West Virginia Code 11-15-8d, extends this tax exemption to Contractor’s supplying goods on their behalf. The Contractor shall coordinate with the Town the filling of any and all applications to the State of West Virginia, exempting the purchase of the specified Goods from West Virginia Sales Tax and hereby agrees to include the savings from such sales tax exemption in its total base bid.” WV ALCOHOL AND DRUG FREE WORKPLACE ACT West Virginia Code 21-1D-5 provides that any solicitation for a public improvement construction contract requires each vendor that submits a bid for the work to submit at the same time an affidavit must be signed and submitted in the first envelope as evidence of the vendor’s compliance with the provision of article 1D, Chapter 21 of the West Virginia Code. Failure to submit the signed Drug-Free workplace affidavit in the first envelope shall result in disqualification of such bid. NOTICE OF FEDERAL WAGE REQUIREMENTS Contractors are required to comply with all laws pertaining to federal wage rates as issued in accordance with the Davis Bacon Act. The Contractor will be required to pay the federal wage rates appropriate for each worker classification. Any contract or contracts awarded under this invitation for bids is expected to be funded by a grant from the West Virginia Department of Economic Development, Community Advancement Department- Community Development Block Grant – Mitigation Program.
