TRUSTEE’S SALE OF
VALUABLE REAL ESTATE

The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated May 24, 2012, and duly recorded in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed of Trust Book 1029, Page 665, Francis M. Litz and Linda E. Litz did convey unto L. Richard Dorsey, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Marion County Courthouse, in Fairmont, West Virginia, on

April 17, 2025, at 4:47 PM

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Lincoln District, Marion County, West Virginia, and more particularly described as follows:

All those certain lots, tracts or parcels of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in the the Town of Worthington, Lincoln District, Marion County, West Virginia, being all of Lot No. 8 and Lot No. 9 in New Addition, and more particularly described as follows:

Lot 8: Beginning at a stake, corner to Lots 9 and 10 of said addition, owned (or formerly owned) by W. I. Nutter and Oscar Cochran, and running thence N. 18 3/4 degrees W. 100 feet to a stake in line of main street; thence S. 18 3/4 degrees E. 100 feet to a stake, corner to said W. I. Nutter and said Martin Oski; and thence N. 71 1/4 degrees E. 50 feet to the place of beginning, containing 5,000 square feet, more or less; and

Lot 9: Beginning at the corner of Lot No. 8, now known as the Peter Yerkovitch property, formerly the R.G. Brooks Property, designated by an iron pin in the ground, and running thence N. 71 1/4 degrees E. 50 feet to a post; thence S. 18 3/4 degrees E. 98 feet to the lower street, formerly known as the county road; thence with said street, S. 72 degrees W. 50 feet to an iron rod in the ground; and thence N. 18 3/4 degrees W. 97 feet to the place of beginning, containing approximately 4900 square feet; all as set forth on a map or plat of same or record in the Office of the Clerk of the County Commission of Marion County In Deed Book 133, Page 333.

At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 228 Main Street, Worthington, WV 26591.

AND BEING the same real estate which was conveyed to Francis M. Litz and Linda E. Litz, by Deed dated May 24, 2012, from Fred Alan Mayer, Peggy Sue Mayer and James Partin, Betsy Partin, and recorded in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed Book 1113, at Page 829.

The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
