The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated March 1, 2019, and duly recorded in the Office of the Clerk of the County Commission of Hampshire County, West Virginia, in Deed of Trust Book 631, at Page 515, John H. Emmel, III and Deborah L. Emmel did convey unto William C. Keaton and/or W. Joseph Milleson, Jr., Trustees, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Hampshire County Courthouse, in Romney, West Virginia, on

May 6, 2025, at 3:04 p.m.

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Bloomery District, Hampshire County, West Virginia, and more particularly described as follows:

All that certain tract or parcel of land situate in Bloomery District, Hampshire County, West Virginia, containing 71.32 acres, more or less, lying on the west side of County Route 45/6 and being more particularly bounded and described as shown on that certain Description of Survey and Plat of Survey for Daniel Frank Hartsook, as prepared by Edward J. Mayhew, P.S., dated July 5, 2004, a copy of which Description of Survey and Plat of Survey are of record in the Office of the Clerk of the County Commission of Hampshire County, West Virginia, in Deed Book 462, at Pages 329-330. Said real estate is shown on the 2018 Hampshire County Land Books as being Tax Map 7, parcel 7 for said district.

And being the same real estate which was conveyed unto John H. Emmel, III, and Deborah L. Emmel, by deed of Curtis G. McKay and Kelli L. McKay, his wife dated February 19, 2019, and to be recorded prior to or contemporaneously with the recordation of this instrument in the Office of the Clerk of the County Commission of Hampshire County, West Virginia.

Pursuant to Chapter 38, Article 1, Section 4, of the West Virginia Code, any Notice of Trustee’s sale shall be mailed to the grantor (s) hereunder at the following address; or such other address subsequently given to the beneficiary in writing by the grantor (s) : 25 Scholarship Lane, Martinsburg, WV 25404.

The Trustee’s fee is fixed as a commission of Six Percent (6%) upon the gross sale price of the property; however, in the event it becomes necessary to advertise the said real estate in the enforcement of this deed of trust, and the debt be paid prior to sale, then the grantor (s) shall pay a commission to the trustee of three percent (3%) of the amount of the debt remaining unpaid at the time of advertisement.

At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 25 Scholarship Drive, Martinsburg, WV 25404.

AND BEING the same real estate which was conveyed to John H. Emmel, III and Deborah L. Emmel, by Deed dated February 19, 2019, from Curtis G. McKay and Kelli L. McKay, and recorded in the Office of the Clerk of the County Commission of Hampshire County, West Virginia, in Deed Book 555, at Page 301.

The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
