NOTICE OF SPECIAL COMMISSIONER SALE OF VALUABLE REAL ESTATE The undersigned Special Commissioner, by virtue of the authority vested in him by that certain Agreed Order Resolving Civil Action Through Sale by Marketing or Judicial Foreclosure entered February 13, 2025, by the Circuit Court of Kanawha, West Virginia, and pursuant to the authority set forth in West Virginia law, will offer for sale at public auction to the highest bidder at the front door (Virginia St. E.) of the Courthouse of the County of Kanawha, in Charleston, West Virginia, on June 6, 2025, at 10:00 a.m., the following condominium residence unit situate in a multi-unit area known as Terrace Park East, a Condominium, in the City of Charleston, Kanawha County, West Virginia, as shown and designated on a map thereof hereinafter mentioned, which said condominium residence unit is more particularly described as follows: All of Residence Unit No. B-626 in Building 2 of Terrace Park East, a Condominium as the same is shown on the Declaration plan entitles, “Map Showing Declaration Plan for Terrace Park East Condominium, a Condominium Development of Jamon Real Estate Corporation, located in the City of Charleston, W.Va., Scale: 1″ = 20′ October 30, 1979”, made by Field Engineering Co., Charleston, West Virginia, and of record in the Office of the Clerk of the County Commission, Kanawha County, West Virginia, in Map Book ____, at Page ___ (hereinafter called “Declaration Plan”); Together with the undivided interest as tenants in common in and unto the common elements which is assigned to said Residence Unit No. B-626 and described in the Declaration of Condominium of Terrace Park East, A Condominium, 2106 Kanawha Boulevard, East, Charleston, West Virginia, 25311, pursuant to Chapter 36A of the West Virginia. Code of 1931 as amended (known as the Unit Property Act), which said declaration is dated December 3, 1979, and of record in the aforesaid Clerk’s Office in Deed Book 1928 at Page 748, and which is hereinafter called “Declaration”; AND BEING the same property conveyed unto Virgil E. Matthews by that certain deed from Jamon Real Estate Corporation, a West Viginia corporation, dated December 28, 1979, and recorded in the Office of the County Clerk of Kanawha County, West Virginia, in Deed Book 1931, at page 551. Virgil E. Matthews died testate, and by virtue of his Last Will and Testament, recorded in the Clerk’s office in Will Book 970, at Page 604, title vested in Michael A. Matthews and Deborah Michele Matthews. TERMS OF SALE 1. Cash in hand paid on day of sale by wired funds or certified check; provided, however, the Special Commissioner may accept credit bids and proof of funds, or other evidence of funds, and accept receipt thereof within five (5) days of the sale or as otherwise determined by the Special Commissioner. Failure by the highest bidder to provide funds as directed by the Special Commissioner will result in their bid being forfeited and the next highest bidder being declared the winner. 2. The sale is subject to any and all applicable assessments and taxes against the real property. 3. The purchaser shall pay the excise transfer tax imposed by W.Va. Code 11-22-2. 4. The Special Commissioner reserves the right to adjourn the sale for a time or from time to time, without further notice, by announcing the time and place of the sale described above for any adjournment thereof. 5. The real property will be sold in “as is” condition. The Special Commissioner will have no duty to cause any tenant or person occupying the real property to vacate. 6. The Special Commissioner makes no representations or warranties related to the real property. 7. The Special Commissioner will deliver a Special Commissioner’s quitclaim deed to the purchaser without any covenant or warranty (express or implied). 8. The Special Commissioner makes no representations and warranties about the title of the real estate to be conveyed. 9. If there is one or more valid and enforceable federal tax liens against the real property, the United States will have the right to redeem the real property within a period of 120 days from the date of the sale or the period allowed for redemption under state law, whichever is longer. 10. Lienholders may present claims against the above referenced real property for adjudication by the Special Commissioner on or before May 23, 2025. 11. This notice satisfies the requirements of W. Va.
