MICHELLE FORE and UNKNOWN HEIRS O F BARBARA HORTON, Defendants ORDER OF PUBLICATION TO THE ABOVE-NAMED RESPONDENT: The Plaintiff filed Complaint for Partition by Sale in the above-styled action. A copy of the Complaint for Partition by Sale may be obtained from the Kanawha County Circuit Clerk located at 111 Court Street, Charleston, WV 25301. The object of this action is to either: (a) order partition of the said real property located in the Poca District of Kanawha County, West Virginia, or (b) if a partition cannot be made, appoint a Special Commissioner for the purpose of conducting a sale of said real property located in the Poca District of Kanawha County, West Virginia, and making distribution of the net proceeds from said sale among the parties according to the interest of each. The property consists of a tract of land located in the Poca District of Kanawha County, West Virginia, containing one hundred thirty-four (134) acres, by deed dated January 29, 1910, in Deed Book 120, at page 99; less 6.01 acre, more or less, by deed dated August 13, 2004, in Deed Book 2610, at page 326. Pursuant to an Affidavit filed by Plaintiff’s counsel, the address of the Respondent, Michelle Fore, is unknown. The identity of the “unknown” heirs of Barbara Horton, is not ascertainable and therefore they are identified by the category of “unknown heir of Barbara Horton.” Therefore, it is ORDERED that the Respondents must appear and defend within thirty (30) days by serving an answer or other defense to the Complaint for Partition by Sale upon the Plaintiff’s attorney, Lisa M. Moye, whose address is P.O. Box 535, Winfield, West Virginia 25213. Otherwise, judgment by default will be rendered against the Respondent at any time thereafter.
