WEBSTER SPRINGS PUBLIC SERVICE DISTRICT WASTEWATER COLLECTION & TREATMENT SYSTEM UPGRADE ADVERTISEMENT FOR BIDS Sealed Bids for the construction of: Webster Springs PSD – Wastewater Collection & Treatment System Upgrade Contract No. 1 – Furnishing all materials, labor, and necessary items for the construction and installation of approximately 50 linear feet of 16″ diameter gravity sewer main, 60 linear feet of 14″ diameter ductile iron pipe, 580 linear feet of 6″ diameter gravity sewer main, 275 linear feet of 4″ diameter laterals, 2,770 linear feet of 12″ force main, 275 linear feet of 3″ diameter force main, 235 linear feet of 1-1/2″ diameter force main, 3 manholes, 6 force main cleanouts, five (5) lift station site modifications, two (2) lift stations, one (1) grinder pump station, one (1) headworks unit, WWTP Existing Plant Pump Station Modifications, WWTP Chlorine Contact Chamber Modification, WWTP Sludge Pumps Replacement, WWTP Clarifier Weir Replacement, WWTP Grit Chamber Modifications, WWTP Aeration Basin Weir Plate Repair and other related appurtenances as outlined in the Plans and Specifications. Sealed Bids for the construction of Contract No. 1 will be received by Steve Jordan (PSD Chairman) at the office of the Webster Springs PSD, 38 Clean Water Way, Webster Springs, WV 26288., until 2:00 p.m. local time on July 8, 2025, at which time the Bids received will be publicly opened and read. A non-mandatory pre-bid conference will be conducted at the Webster Springs PSD, 38 Clean Water Way, Webster Springs, WV at 1:00 p.m. on June 24, 2025. Contract Times: 240 calendar days to substantial completion and 270 calendar days to complete work ready for final payment. Bidders on this work will be required to comply with the President’s Executive Order 11246, HUD Section 109, which prohibits discrimination in employment regarding race, creed, color, sex or national origin, and have non-segregated facilities. This CDBG-Small Cities Block Grant project is to be financed in part by a grant from the United States Department of Housing and Urban Development (HUD) and the West Virginia Development Office and will be referred to as Webster Springs PSD – Wastewater Collection & Treatment System Upgrade Project. The work to be performed under this contract is subject to the requirements of Section 3 of the Housing and Urban Development Act of 1968, as amended, 12 U.S.C. 170l u (Section 3). The purpose of Section 3 is to ensure that employment and other economic opportunities generated by HUD assistance or HUD-assisted project covered by Section 3, shall, to the greatest extent feasible, be directed to low- and very low-income persons, particularly persons who are recipients of HUD assistance for housing. The parties of the contract agree to comply with HUD’s regulations in 24 CFR Part 135, which implement Section 3. Bidder’s attention is directed to the Section 3 “Clause” set forth in the contract documents. Bidders must comply with the requirements for Affirmative Action and Minority Business Enterprises participation as described in the Federal Specifications insert to the Contract Documents. Bidders must comply with Title VI of the Civil Rights Act of 1964, the Davis-Bacon Act, and the West Virginia Division of Labor Wages for Construction of Public Improvements pursuant to West Virginia Code 21-5A-3. Bids shall be submitted on the furnished Bid forms. Bids shall be on a unit price basis as indicated on the Bid Form. The bids shall be submitted using the two (2) envelope system. A five percent (5%) Bid Bond or certified cashier’s check must accompany all Bids. The successful Bidder will be required to furnish a satisfactory Payment Bond and Performance Bond, each for 100% of the contract amount. No Bidder may withdraw their bid for a period of ninety (90) days after the time of the opening of the Bids. All bidders are required to have a West Virginia contractor’s license per Section 21-11-11 of the West Virginia Code. A Contractor’s License Number is to be included on the bid submission. Any Contractor submitting a Bid on this project hereby certifies, indicates and acknowledges that he/she has a license and meets all the qualifications required by the statutes of the State and Subdivision in which the work is to be performed. DBE Requirements Each Bidder must fully Comply with the Disadvantaged Business Enterprises, and Affirmative Action Requirements, as identified in the contract documents. The Bidder agrees to make “positive efforts” to subcontract a portion of the total value of the contract to Disadvantaged Business Enterprises. This shall be done in compliance with the six (6) affirmative steps as outlined in 40 CFR 33.240. Failure to demonstrate positive efforts to do so may lead to rejection of bids. For this program, the term “subcontract” includes all construction, modification, and service work contracted for by the bidder in the execution of the work under this contract. American Iron and Steel Requirement P.L. 113-76, Consolidated Appropriations Act, 201 (Act), includes an “American Iron and Steel (AIS)” requirement in section 436 that requires Clean Water State Revolving Loan Fund (CWSRF) and Drinking Water State Revolving Loan Fund (DWSRF) assistance recipients to use iron and steel products that are produced in the United States for projects for the construction, alteration, maintenance, or repair of a public wastewater and water system or treatment works. Pursuant to West Virginia Code 5-22-2, requirements stated in the advertisement for bids and the bid form may not be waived by any public entity. All bidders are required to have a WV contractor’s license in accordance with Section 21-11-11 of the WV State Code. The Owner reserves the right to reject any or all bids. Each Bidder must submit with his bid, security in the amount, form, and subject to the conditions provided for in the Information for Bidders. No Bidder may withdraw his bid within 90 days after the actual date of the opening thereof. All fees associated with the purchase of Project Specifications, Contract Documents, Plans, and Shipping are non – refundable.
