Notice is hereby given that the undersigned Substitute Trustee, appointed by documents dated May 9, 2025, and of record in the Office of the Clerk of the Wetzel County Commission in Deed of Trust Book 463, at page 604, and Wetzel County Commission in Deed of Trust Book 463, at page 604, will sell at public auction to the highest bidder on:
June 23, 2025,
at 11:00 a.m.,
at the front door of the Wetzel County Courthouse, 200 Main Street, New Martinsville, West Virginia, that certain property conveyed by Jacqueline N. Piekarski and Michael J. Piekarski, to Ronal W. Rush, original Trustee, by Deed of Trust dated September 8, 2015, and recorded in the office of the said Clerk of the County Commission of Wetzel County, West Virginia, in Deed of Trust Book 390, at page 233, and conveyed by Jacqueline N. Piekarski and Michael Piekarski, to Ronal W. Rush, original Trustee, by Credit Line Deed of Trust dated April 22, 2016, and recorded in the office of the said Clerk of the County Commission of Wetzel County, West Virginia, in Deed of Trust Book 395, at page 534, and being described as follows:
All of a certain piece of land with the appurtenances thereunto belonging, situate in Martin’s Addition to the City of New Martinsville, Magnolia District, Wetzel County, West Virginia, and bounded and described as follows:
Beginning at a stone corner at the southwest corner of the intersection of Martin Avenue and Virginia Street; thence with the southerly line with Virginia Street in a westerly direction 118 feet to a stake at the intersection of an alley with said street; thence with the eastwardly line of said alley in a southerly direction 32 feet to a stake corner to Malls lot, formerly William Koontz, and with same eastwardly 118 feet to a stone corner in the west side of Martin Avenue and thence with the west side of said street northwardly 38 feet to the place of beginning, which said lot fronts 38 feet on Martin Avenue, 118 feet on Virginia, 32 feet on the alley in the rear thereof, said lot being part of Lot 58 in said addition as the same appears on the recorded plat of said Martin’s Addition in the Wetzel County Clerk’s Office in Plat Book No. 1, at page 40.
Being the same property conveyed to Michael J. Piekarski and Jacqueline N. Piekarski, husband and wife, by William D. Stuart and Rae Ellen Stuart, husband and wife, by Deed dated May 9, 2001, and recorded in Wetzel County Deed Book 372, at page 326.

The terms of the sale will be as follows: Cash in hand on the day of sale. Sale of said property will be made subject to: (1) All prior exceptions, reservations, rights of way, easements, conditions, covenants, restrictions, leases and other servitudes of record if any pertaining to said real estate; (2) any and all unpaid taxes assessed against said property; (3) the subject property will be sold in “as is” condition; (4) the Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property; (5) the Substitute Trustee will deliver a Substitute Trustee’s Deed to the purchaser without any covenant or warranty (expressed or implied) in the form prescribed by West Virginia Code Chapter 38-1-6. The Substitute Trustee makes no representations and warranties about the title of the real estate to be conveyed.
Any sale hereunder may be adjourned from time to time without notice other than oral proclamation at the time and place appointed for the sale. The Substitute Trustee reserves the right to reject any or all bids. Additional terms and conditions shall be announced at the sale.
Any sale hereunder in which the property is encumbered by Federal Tax Liens will be subject to the 120-day redemption period pursuant to 26 U.S.C.A. Section 7424(d).
