NOTICE OF TRUSTEE’S SALE
NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Trustee, Richard A. Pill, by that certain Deed of Trust dated February 12, 2024, executed by the Borrower, Corey M. Cochran, to Richard A. Pill, the Trustee, of record in the office of the Clerk of the County Commission of Hampshire County, West Virginia, in Book 710, at Page 13. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 290 SHORT MOUNTAIN DR., AUGUSTA, WV 26704. The Borrower defaulted under the Note and Deed of Trust and the Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Trustee will sell the following described property to the highest bidder at the front door of the Courthouse of Hampshire County, in Romney, West Virginia, on the following date:
June 10, 2025, at 3:00 p.m.
All those certain tracts or parcels of real estate situate in Sherman District, Hampshire County, described as follows: FIRST TRACT: All those certain tracts or parcels or real estate known as Lot Nos. 43, 44, 45, 46 and 47 as shown on the map or plat of Elk Horn Subdivision, Section One, said plat being of record in the Office of the Clerk of the County Commission of Hampshire County, West Virginia, in Map Book No. 1, at Page 67, said Lots fronting on Short Mountain Drive, a street as shown on said Plat. Said plat is incorporated herein for a more particular description of said real estate, and for any and all pertinent and proper purposes. SECOND TRACT: All those certain tracts or parcels of real estate known as Lot No. 3, containing 1.381 acres, more or less, and Lot No. 4, containing 0.46 of an acre, more or less, as shown on the map or plat of Elk Horn Subdivision, Section Four, said plat being of record in the Office of the Clerk of the County Commission of Hampshire County, West Virginia, in Map Book No. 4, at Page 59, said Lots fronting on Water Street (also known as Huckleberry Lane), a street as shown on said Plat. Said plat is incorporated herein for a more particular description of said real estate, and for any and all pertinent and proper purposes. Lot No. 3 is more particularly bounded and described as follows: Beginning at (1) a stake and iron pipe in concrete, at the South-West corner of Lots #42 and 42, Section #l, and common to the North-East corner of Lot #2 of Section #4; thence, with said Lot #2-Section #4, S 31° 39` 48” E., 200.65 feet to (2) an iron rod, at the West corner of said lot, at the North-East edge of Water Street”, a 40 foot wide Street; thence, with the North- East side of Water Street, N 58° 20` 12” W., 298.45 feet to (3) an iron rod, set; thence N 31° 39` 48” E., 202.47 feet to (4) an iron rod (replacing a wooden stake, found), at the South-West common corner to Lots #50 & 51 of Section #l; thence, with said lots, S 57° 59` 07” E., 298.46 feet to the beginning, containing 1.3810 acres. Lot No. 4 is more particularly bounded and described as follows: “Beginning at a 5/8 inch rebar in the northeastern boundary of Water Street; thence with the line of Water Street N. 57 46 41 W., 95 feet to a rebar; thence leaving the Street N. 30 43 34 E., 207.05 feet to a rebar; thence in a southeasterly direction 49.81 feet to a rebar; thence S. 52 30 E., 50.81 feet to a rebar and a corner to the Vernon Wagoner lot; thence with the line of the Vernon Wagoner lot S. 32 13 19 W., 202.47 feet to the beginning, containing 20,106 square feet, more or less.” Lots 42 through 47 and Lot No. 3 have been consolidated for tax purposes and are depicted on the Hampshire County Land Books as containing 2.24 acres, and being Tax Map 12A, Parcel 47, for said district. Lot No. 4 is depicted on the Hampshire County Land Books as containing 0.46 of an acre, and being Tax Map 12A, Parcel 174, for said district.
And being all and the same real estate which was conveyed unto Corey M. Cochran, by deed of Gary P. Straub, Sr., and Sharon J. McLaren-Straub, his wife, dated February 12, 2024, and recorded in the Office of the Clerk of the County Commission of Hampshire County, West Virginia, in Deed Book 601, at Page 438.
TERMS OF SALE:
1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
