TRUSTEE’S SALE
NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated May 8, 2023, executed by the Borrowers, Deborah K Taylor, Member of the Taylor 2014, LLC and Scott A Taylor, Member of Taylor 2014, LLC, to John E. Gompers, the Trustee, of record in the Office of the Clerk of the County Commission of Ohio County, West Virginia, in Book 1673, at Page 71. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 1910 Jacob Street, Wheeling, WV 26003. Pill & Pill, PLLC was appointed as Substitute Trustee by APPOINTMENT OF SUCCESSOR TRUSTEE dated March 26, 2025, of record in the Clerk’s Office in Book 1701, at Page 71. The Borrowers have defaulted under the Note and Deed of Trust and the Substitute Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustee will sell the following described property to the highest bidder at the front door of the Courthouse of Ohio County, in Wheeling, West Virginia, on the following date:
July 9, 2025 at 10:30 a.m.
The following parcel of land situate on the easterly side of Jacob Street, City of Wheeling, Union District, Ohio County, West Virginia, and being the southerly part of Lot 11, as shown on the Plat of Old Town, East Wheeling Addition, recorded in the Office of the Clerk of the County Commission of Ohio County, West Virginia in Deed Book 57, page 570, and part of an adjacent sidewalk intended to be abandoned by Ordinance No. 6446 of the Council of the City of Wheeling, passed January 10, 1978, and in fact abandoned by Ordinance No. 11038 passed July 2, 1996, which amended and reenacted Ordinance No. 6446, and being more particularly described as follows:
Beginning at a point in the easterly line of Jacob Street, said beginning point being located S. 10 54 E. 120 feet from the intersection of said westerly line with the southerly line of 19th Street as shown on said plat; thence from said beginning point crossing through said Lot 11, N. 79 00′ E. 60 and 66/100 feet to a point in the division line between Lots 11 and 12 as shown on said plat; thence with same S. 10 54′ E. 263 feet to a point in Big Wheeling Creek; thence down same, S. 79 00′ W. 60 and 66/100 feet to a point in said easterly line of Jacob Street; thence with same, N. 10 54′ W, 168 and 7/10 feet to a point; thence crossing through Jacob Street, the following three (3) bearings and distances: S. 79 06′ W. 14 feet to a point in the westerly face of the easterly curb line of Jacob Street; thence with same, N. 10 54′ W. 85 feet to a point; thence N. 79 06′ E. 14 feet to a point in said easterly line of Jacob Street; thence with same, N. 10 54′ W. 9 and 3/10 feet to the place of beginning, containing three hundred ninety-three one thousandths (393/1000) acres, (17,143.55 square feet), more or less, from calculations made by Stegman & Schellhase, Inc., Civil Engineers & Surveyors, Wheeling, West Virginia, on June 18, 1996.
The above described parcel of land is subject to any and all conditions, exceptions, reservations, stipulations, rights of way, etc., which may be contained in former deeds of conveyance.
Being the same property which was heretofore conveyed to Taylor 2014, LLC, by R. James Taylor and Deborah K. Taylor, husband and wife, by a deed dated the 13th day of May, 2014, and recorded in the office of the Clerk of the County Commission of Ohio County, West Virginia, in Deed Book No. 871, at page 526.
TERMS OF SALE:
1. The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
2. The Purchasers shall be responsible for the payments of the transfer taxes imposed by the West Virginia Code § 11-22-1.
3. The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4. The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5. The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
6. The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
