AN ORDINANCE TO INCREASE THE MINIMUM
SPECIAL CHARGES FOR MUNICIPAL SERVICES
(AN AMENDMENT TO ARTICLE 767.01 OF THE CODIFIFED
ORDINANCES OF THE CITY OF PADEN CITY,
WEST VIRGINIA)
WHEREAS, the Common Council of the City of Paden City is empowered by the West Virginia Code, Chapter 8, Article 13, Section 13, to impose by ordinance upon the users of special municipal services, reasonable rates, fees and charges to be collected in the manner specified in the ordinance upon the users of such
special municipal services.
WHEREAS, the Common Council has determined
that the current rates charged for essential
municipal services are insufficient to cover the costs
associated with police protection within the municipality.
WHEREAS, it is the intent of the Common Council
to provide that reasonable rates, fees and charges
be collected from the users to ensure the continuance
of all essential special municipal services
in the City of Paden City.
NOW, THEREFORE, IT IS HEREBY ORDAINED BY THE COMMON COUNCIL OF THE CITY OF PADEN CITY, WEST VIRGINIA, THAT THE FOLLOWING AMENDMENTS BE ADOPTED AND MADE A PART OF THE CODIFIED ORDINANCES OF THE CITY OF PADEN CITY, to-wit:
ARTICLE 767.01 shall be deleted in its entirety with
the following substituted in place thereof:
767.01 LEVY.
There is hereby levied and shall be collected a charge
against industrial, commercial and residential users of
Municipal Services situated within the Municipality for
essential Municipal Services. including police protection,
street lighting, and street maintenance. The charge for
such services shall be as follows:
INDUSTRIAL RATES
CLASS I INDUSTRIAL $51.75
Industries, manufacturers,
distributors and
suppliers have more than
50 employees
CLASS II- INDUSTRIAL $40.25
Industries, manufacturers,
distributors and
suppliers having less than
50 employees
COMMERCIAL RATES
CLASS I – COMMERCIAL
School, banks, bars, taverns, $51.75
lounges, lodges, fraternal
organizations, financial institutions
and savings and loan
CLASS II-COMMERCIAL
Department stores, grocery stores, $40.25
markets and service stations
CLASS III-COMMERCIAL
All other businesses and institutions, $24.15
including but not limited to barbers, hair
stylists, cosmetologist, physicians,
insurance agents, funeral establishments,
commercial storage
facilities, day care facilities
RESIDENTIAL RATES
Charge for such services shall be for $17.25
a residence such as dwelling, mobile
home, double
wide, modular, etc., whether occupied
or not. This is a flat rate per month for
all customers of the
municipality who reside in the City limits
and there will be no exceptions. If the
establishment is or was considered to be
a residence, a charge
of $17.25 per month will apply.
This Amendment shall become EFFECTIVE on the
1st day of August, 2025.
