NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by the virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated July 08, 2005, executed by the Borrower, Guy A. Pedersen, to Richard A. Pill, the Trustee, of record in the Office of the Clerk of the County Commission of Hampshire County, West Virginia, in Book 397, at Page 587. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of HC 71 Box 79, Augusta, WV 26704, and, upon information and belief, is now known as 161 Sandy Rock Rd., Augusta, WV 26704. Pill & Pill, PLLC was appointed as Substitute Trustee by an Appointment of Successor Trustee recorded in said Clerk’s Office on May 11, 2016 in Book 597, at Page 479. The Borrower defaulted under the Note and Deed of Trust and the Substitute Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustee will sell the following described property to the highest bidder at the front door of the Courthouse of Hampshire, in Romney, West Virginia on the following date:

July 17, 2025, at 9:34 a.m.

A tract or parcel of land against the east side of Cooper Mountain, about 0.3 mile north of U.S. Route 50 and about 2.5 miles west of Capon Bridge, lying in Bloomery District of Hampshire County, West Virginia and more particularly described as follows:

Beginning at a 5/8” rebar found at the northernmost corner of a 10.009 acre tract previously conveyed to Kirby Curtis Dove, (Deed Book 396, Page 634), Thence leaving the 10.009 acre tract and running with a new division line through the 405 acre tract of which this is a part

N 52° 41’ 38” E. 1130.45’ to a 5/8” x 30” rebar and stone pile set in a line of a 45.000 acre tract previously conveyed to Dale W. Bidle (Deed Book 403, Page 493) located S 53° 59’ 53” E. 165.35’ from a 5/8” rebar found at a corner to said 45.000 acre tract, thence running with a portion of a line of same

S 53° 59’ 53” E. 897.80’ to a 5/8” rebar found in line on the north side of County Route 50/24, the same course continued 20.00’ further for a total of 917.80’ to a point in the center of said road, thence running out the center of the County Road

Heavner and as shown on a plat attached hereto and made a part of this description and being a portion of a tract of 405 acres conveyed by Robert. W. Watson and Marjorie D. Watson to Robert R. Kessel by Deed dated September 22, 1998 and recorded in the office of the Clerk of Hampshire County, West Virginia in Deed Book 387 at Page 32.

Being the same property conveyed to Guy A. Pedersen by Robert R. Kessel by deed dated August 15, 2001 and recorded in Deed Book 408 at Page 219.

TERMS OF SALE:

1. The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

2. The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-2-1.

3. The Beneficiary and/or Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4. The Trustee reserves the right to continue sale of the subject property from time to time by written oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5. The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after foreclosure sale will be deeded to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6. The total purchase price is payable to the Trustee within thirty (30) days of the sate of sale, with ten percent (10%) of the total purchase price payable to the Trustee at sake,
