NOTICE OF FILING

On June 3, 2025, Cardinal Natural Gas Company Southern Division (Cardinal) filed an Application for approval of an Infrastructure Replacement and Expansion Program for 2026 (2026 IREP) with revised IREP rates, pursuant to W.Va. Code §24-2-1k, which authorizes the Public Service Commission of West Virginia to approve expedited cost recovery of projects to replace, upgrade and expand natural gas utility infrastructure deemed to be just and reasonable and in the public interest.

In its Application, Cardinal forecasts capital investment for its 2026 IREP Year of approximately $2.3 million as part of its multi-year plan. The 2026 IREP covers several categories of plant asset improvements, including mains, services, meters, and other plant equipment. The Application is on file and available for public inspection at the Commission’s offices at 201 Brooks Street, Charleston, West Virginia, and online.

Cardinal proposes to recover costs associated with these investments through an increment within the volumetric base rate component of its rates, to be effective on November 1, 2025. A true-up adjustment will align the recovery increment to actual costs. Cardinal projects that if the program and rate increment adjustment are approved as requested, the average monthly bill for its various classes of customers will be changed on November 1, 2025, as follows:

The changes shown above are compared to the rates currently in place and are based on averages of all customers in the indicated class. Each class may receive an increase greater or less than stated here. Individual customers may receive increases that are greater or less than average.

The Commission has scheduled an evidentiary hearing on the Application, if necessary. The hearing is scheduled to begin at 11:00 a.m., on August 19, 2025, in the Municipal Board Room, Bluefield City Hall, 200 Rogers Street, Bluefield, West Virginia. If no opposition to the Application is received by the Commission within one week of the hearing date, the hearing may be waived and the Commission may issue a final order within one hundred fifty days of the Application filing date.

Anyone desiring to intervene should file a written petition to intervene within twenty days following the date of this publication unless otherwise modified by Commission order. All requests to intervene should briefly state the reason for the request to intervene and comply with the rules on intervention set forth in the Commission Rules of Practice and Procedure. The Commission will receive public comments until the beginning of the hearing. LOT NUMBER TWENTY-SIX (26), as shown on a revised plat of record in said Clerk’s Office in Deed Book No. 653, at Page 112 (originally being Lot No. 26 and the western one-half of Lot No. 27), described as follows:
Beginning at a stake in the line of Rosewood Avenue, corner to Lot No. 28, and thence N. 84º 30’ W. 90 feet to a stake; thence N. 5º 30’ E. 140 feet to a stake; thence S. 84º 30’ E. 90 feet to a stake; and thence S. 5º 30’ W. 140 feet to the place of beginning.
Subject to all reservations, covenants, exceptions, restrictions, limitations, easements, agreements and rights of way set out in prior deeds or other instruments that comprise the chain of title, including mineral reservations and privileges thereunto belonging, and by which the Grantor is bound in the ownership of the said real estate insofar as the same are now in force and effect.
Being the same lot or parcel of real estate conveyed unto Michael W. Easter, by Nicholas Scott Merashoff, by that General Warranty Deed dated May 8, 2008, and of record in the Office of the Clerk of the County Commission of Marion County, West Virginia in Deed Book 1036, at Page 523.
And further being the same real estate conveyed unto Anthony J. Quattro, by Deed from Michael W. Easter, to be recorded simultaneously with the recording of this Deed of Trust.

At the time of the execution of the Deed of Trust, this property was reported to have an address of: 141 Rosewood Ave, Fairmont, WV 26554.

The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: $9000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.

FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
