Notice of Petition for Forfeiture

Any claimant of the property described below has the right to tile a claim in the Office of the Circuit Clerk of Preston County not more than 30 days after the first publication of this Notice. Any such claim must clearly state the identity of the claimant and an address where legal process can be served upon that claimant. 1f you fail to file an answer, a final order forfeiting the property to the State will be entered, and such order is not subject to appeal.
Now comes the Petitioner, State of West Virginia, by Megan M. Fields, Chief Assistant Prosecuting Attorney of Preston County, on behalf of the Preston County Sheriffs Department and petitions the Court for forfeiture of certain seized property pursuant to West Virginia Code §60A-7-70 l, et seq. In support thereof, the Petitioner avers as follows:
1. Petitioner is State of West Virginia on behalf of the Preston County Sheriffs Department.
2. Respondent is a $48,308.00 U.S. Currency; and a Canik 9mm Firearm; all of which were seized from the possession of Mohammed Mohammed Hussein, (Accused 1), whose last known address was 212 W. Main Street, Kingwood, WV 26537; King Tobacco & Vape, LLC, (Accused 2), whose principal place of business was 4 Rainbow Plaza, Mannington, WV 26582; Rageh Hussein (Accused 3), whose last known address was 4 Rainbow Plaza, Mannington, WV 26582; and/or Abdullah Mohammed Hussein (Accused 4), whose last known address is Unknown.
3. Petitioner seeks the forfeiture of the following seized property: a) $48,308.00 U.S. Currency; and b) Canik 9 mm T6472 firearm; Serial No. CC 00 568.
4. The property sought to be forfeited was seized by law enforcement personnel of the Preston County Sheriff’s Department, subsequent to a search warrant executed on March 25, 2025 at approximately 8:36 p.m.
5. The property sought to be forfeited was seized from Accused I, Accused 2, Accused 3 and/or Accused 4, in or near Kingwood, Preston County, West Virginia and was equipment and currency used in illegal drug trafficking, i.e., by facilitating the possession of and delivery of controlled substances. The $48,308.00 U.S. Currency and Canik 9 mm firearm sought to be forfeited was discovered by law enforcement in the possession of Accused I, Accused 2, Accused 3 and/or Accused 4, subsequent to the execution of a search warrant on March 25, 2025. Two (2) “controlled buys” at the direction of the Preston County Sheriff’s Office occurred prior to the date of the executed Search Warrant, at King Tobacco & Vape, LLC.
6. Upon information and belief, the owner of the seized property is Accused l, Accused 2, Accused 3 and/or Accused 4.
7. There are no known persons or corporations having a protected security interest or lien in the subject property, nor are there any known persons or corporations who may be holding a possessory or statutory lien against such property.
Wherefore, your Petitioner prays for an Order directing the forfeiture of the seized property to the Petitioner and vesting ownership of said property with the Petitioner and such other and further relief as the Court finds just
