NOTICE IS HEREBY GIVEN that Arianna Gadaleta, whose hereinafter described property address is 8900 Gatewood Road, Fayetteville, WV has brought the above- styled Civil Action in the Circuit Court of Fayette County, West Virginia, pursuant to the Common Law and Statutes existing in West Virginia, seeking to Quiet Title and to Acquire Title by Adverse Possession which is property formerly owned by a Church and located in Fayette County, West Virginia now owned by Petitioner, Arianna Gadaleta.

At all times herein mentioned Arianna Gadaleta is a resident of 710 Northwestern Avenue Beckley, WV 25801, Raleigh County, West Virginia. Furthermore, she is the owner of the following described real estate: Situate, lying and being on the waters of Crooked Run Creek in New Haven District, Fayette County, West Virginia and more particularly bounded and described as follows:

BEGINNING at a 5/8-inch rebar (found) 15 feet north of the centerline of County Secondary Route 9 (Gatewood Road), corner to Barry W. & Karen S. Clark, from which a 5/8-inch rebar (found), corner to same, bears S. 74o 02’ 10” W 219.05 feet, a Y2-inch rebar (found) on 1 the south side of Gatewood Road bears S 62o01’ 10” E 44.68 feet, and a power pole bears N 72o 40’ 15” E 27.20 feet, thence with said Clark N 32o 47’ 23” W at 153.63 feet passing a 5/8- inch rebar (found), corner to said Barry W. & Karen S. Clark and Danny Ballard, and in all 168.60 feet to a point 15 feet south of the Old Sewell Road, corner to said Ballard, from which an 8-inch Cherry at fence corner, corner to said Ballard, bears S 70o 18’ 00” W 200.64 feet, and a 5/8-inch rebar (found) on the north side of the Old Sewell Road, corner to Joseph S. & Josephine Williams, bears N 81o 36’ 21” E 53.68 feet, thence with the south side of the Old Sewell Road and 15 feet from centerline for eight (8) lines S 75o 36’ 54” E. 91.74 feet to a point, thence S 55o 022’ 34” E 45.74 feet to a point, thence S 66o 30’ 59” E 82.90 feet to a point, thence S 88o 07’ 43” E 37.36 feet to a point, thence S. 89o 54’ 45” E 39.96 feet to a point, thence N 82o 47 54 “ E 49.06 feet to a point, thence S 86o57’ 40” E 38.54 feet to a point, thence N 84o 12’ 27” E 40.71 feet to a point 15 feet south of the centerline of the Old Sewell Road and 15 feet north of County Route 9 (Gatewood Road), from which a telephone pole # 70/2 bears N 78o33’31” W. 28.09 feet, thence with Gatewood Road S 75o 35’ 04” W 308.27 feet to the beginning.

And being the same property deeded to Arianna Gadaleta, by deed dated September 30, 2024 from Douglas Alan Goins, recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia in Deed Book 857, page 190.

Douglas Alan Goins obtained his interest in the above-described real estate from Gwen Mckinley, Clifford Murphy and Constance Harrison, successive trustees of Kaymoor Apostolic Church on January 23, 2007, by deed of record in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Deed Book 628, page 412.

The following parties are the persons who may, or may not, have an interest in litigation that relates to the real estate which is the topic of the above-styled litigation:

Gwen McKinley, Trustee of Kaymoor Apostolic Church or replacement Trustee of Gwen McKinley;

Constance Harrison, Trustee of Kaymoor Apostolic Church or replacement Trustee of Constance Harrison;

Clifford Murphy, Trustee of Kaymoor Apostolic Church or replacement Trustee of Clifford Murphy;

Members of the Congregation of Kaymoor Apostolic Church, known or unknown;

Heirs of the Members of the Congregation of Kaymoor Apostolic Church, known or unknown;

Successor Trustees of Kaymoor Apostolic Church, known or unknown.

You are also notified in the event that those mentioned do not come forward and appear to claim any interest they may have in said real estate and file an answer in the above-mentioned civil action then petitioner will attempt to quiet title and/or establish title by adverse possession in the real estate in question.

THE OBJECT OF THIS SUIT IS TO QUIET TITLE AND ESTABLISH TITLE BY ADVERSE POSSESSION.

It appearing by Petition filed in this action that Gwen McKinley, replacement Trustee of Gwen McKinley, Constance Harrison, or replacement Trustee of Constance
Harrison, Clifford Murphy, or replacement Trustee of Clifford Murphy, Members of the Congregation of Kaymoor Apostolic Church, Heirs of the Members of the Congregation of Kaymoor Apostolic Church and Trustees of Kaymoor Apostolic Church must serve upon G. Todd Houck, Petitioner’s Attorney, whose address is 105 Guyandotte Avenue,
Mullens, WV 25882, an Answer or Objection including any related counterclaim or defense you may have to the Petition to Quiet Title and/or Establish title by Adverse Possession sought in this action within 30 days of this publication. If you fail to do so, thereafter, judgment upon proper hearing and trial may be taken against you for the relief demanded in the Petition. A hearing in this matter is scheduled in the Circuit Court of Fayette County, in the Courthouse in Fayetteville, West Virginia on the 15th day of September, 2025, at 2 PM.
