Keller, Barbara Jean Blankenship, Robert Allen Keller, Marsha Patteson Miller, Mary Elizabeth Patteson, Diana Frame Lintner, Linda Marie Frame, Vicky Frame Reising, Urcie Turner’s Unknown Heirs, Beatrice A. Davidson’s Unknown Heirs, Debra A. Sweat, Elizabeth Ann Cowen, Carmen J. Portera, City of Charleston, Office of the City Collector, Unknown Persons/Owners, and Michael Y. Rutherford, Sheriff of Kanawha County, West Virginia (hereinafter sometimes referred to as “the aforementioned respondents”), that a just compensation hearing has been rescheduled for July 29, 2025, at 1:00 p.m., in the Office of the Court Administrator, First Floor, Suite 100, Kanawha County Courthouse, 111 Court Street, Charleston, West Virginia, 25301, and is known as Civil Action No. 22-P-417, and styled Appalachian Power Company vs. Bernard A. Keller’s Unknown Heirs, et al., to determine just compensation in relation to a Petition for Condemnation/Right of Entry and the Order of Right of Entry which was entered on February 23, 2023. Said just compensation hearing will address just compensation for the interests and rights condemned on behalf of Appalachian Power Company situate in Charleston N District, Kanawha County, West Virginia, identified as Tax Map 1, Parcel 25, and recorded in the office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 746, at page 135, and being more specifically bounded and described as follows: PT LT 1 KELLER SUB BELO 2 MI 1-95/100 Being designated on said map as No. 1, and being bounded and described as follows, to-wit: Beginning at a stake on the southerly side of said U. S. Route 35, and being the lower corner of the property of the party of the first part, as the same adjoins the Preston property, and thence leaving said point and running in a direction of N 83 45 E with the southerly right-of-way line of said U. S. Route 35, said southerly line being located 15 feet from the center line of the original brick pavement, 776 feet more or less to the lower or northwest corner of the M. E. Church lot; thence running towards the Kanawha River and with the Church let S 10 00 E 72 feet to a stake in the northerly right-of-way line of the New York and Central Railroad; thence crossing the Railroad right-of-way line, said Railroad right-of-way line being 66 feet in width to a stake in the southerly line of said Railroad; thence continuing the same course 155 feet to a stake at the mouth of a small ravine at the low water mark of Kanawha River 795 feet more or less to a point in the River bank, being the lower line of the Mary E. Keller property; thence running towards the highway N 17 37 W 80 feet to a stake in the southerly line of said Railroad; thence crossing the Railroad to a stake in the northerly line of the Railroad; thence running in the same direction 103.12 feet to the place of beginning. The aforementioned respondents are hereby notified a copy of said Petition for Condemnation/Right of Entry and Order of Right of Entry may be obtained from the Kanawha County Circuit Clerk’s office at 111 Court Street, Charleston, West Virginia, 25301. The Petition for Condemnation/Right of Entry and Order of Right of Entry may also be obtained from the attorneys for Appalachian Power Company, Jeffrey A. Kimble, Post Office Box 128, 140 West Main Street, Suite 300, Clarksburg, West Virginia, 26302-0128, or Douglas C. McElwee, 700 Virginia Street East, Suite 400, Charleston, West Virginia, 25301. The aforementioned respondents are further notified that at the said hearing to determine just compensation on July 29, 2025, at 1:00 p.m., in the Office of the Court Administrator, First Floor, Suite 100, Kanawha County Courthouse, 111 Court Street, Charleston, West Virginia, 25301, you may appear for hearing and presentation of evidence, and are notified that any failure to appear and/or present evidence may result in the waiver of any defenses or claims, if any, you may have regarding just compensation or otherwise in this action.
